It's an article, with pic as taken by the police, from The Chronicle-Telegram, Elyria, Ohio, 27 August 2007, by Patti Ewald. "An 8-year-old boy has red marks across his back made by a belt. A teacher sees these marks and reports it to authorities. The boy's father, a 28-year-old man, is charged. Lorain County Judge James Burge clears the man of wrongdoing. The prosecution, Burge told our reporter, failed to prove the necessary element of the crime - that the 8-year-old boy had suffered serious physical harm and that the punishment was excessive." "Burge said the marks looked worse than they were. 'Cosmetically they were bad, but I didn't see any deep tissue problems. I didn't see bruises. I saw red marks. I didn't see any welts where the skin was raised.' The reporter expressed her disapproval of the judge's decision, but said that comments on the newspaper's website were overwhelmingly in support of the judge and the father. It's interesting to see the distinction made between *welts* (more serious) and just *marks* (less serious). That's something I haven't really thought about before. Also, the more commonly expressed view that the absence of bruises means the punishment was not excessive. I'm not going to link the article and pic, but it's easy enough to find on the corpun.com website. I agree that the marks look very alarming. There seems to be evidence of at least three vertical and three horizontal belt whacks that left marks. One of the vertical marks reaches as high as the top of the kid's shoulder, so would be less than an inch away from hitting his face. One of the horizontal whacks seems to have hit in the region of vital organs in the lower back. The overall impression is of the parent flailing wildly at the kid with the belt, which doesn't seem like a particularly sensible way of punishing an 8 year old. Why would someone do that, instead of taking the belt to his butt instead? Seems like a loss of control. It's interesting that corpun.com has 22 pics of the effects of school corporal punishment, but only this 1 pic of the effects of parental corporal punishment. I guess this might be because school corporal punishment often comes up in the context of parents making some form of complaint about it, and parents find it appropriate (and have the authority) to take and publish pics of their own kids' sore bottoms. By contrast, authorities handling complaints about parents often don't have the authority or the inclination to publish pics of the effects of the punishment. By coincidence, most schools (and courts) don't spank with belts, which I guess explains the much larger number of cane and paddle effects pics, compared to belt effects pics. The website has even more pics of the effects of judicial corporal punishment, mostly of adults. I think many of these were taken and published by the authorities as a warning to others, so the buttocks' owners didn't get a choice about it. Including in a "prison exhibition" at a still-operational prison, and in pictures shown to schoolchildren. But the three 19 year olds photographed after being birched in the Isle of Man in 1965, seem to have been willingly posing for the camera. A 15 year old from Jersey who was birched in the same era, seems to have had his marks photographed by a newspaper reporter invited by his parents in the context of making a complaint.
