Subject: Fair Employment Practices For The Cayman Islands

There has been a great deal of discussion in the media concerning job opportunities for Caymanians. Many Caymanians feel they are qualified for jobs and are not being given an opportunity to get them. The business community denies this and says that everyone who applies is fairly considered for job opportunities. I would like to suggest a solution to this dilemma.
The government issues work permits and knows exactly when they will need to be renewed, from their computer records. A monthly publication from the Government, which lists work permits, job descriptions, salary, and qualifications, for all job expiring during the next three months and new jobs being created, would inform the public about jobs which will soon be available to qualified Caymanians. Qualified persons could submit applications for these jobs to the Human Resources Department . If the Human Resources Department agrees that the applicant is truly qualified, they would refer the applicant to the employer is seeking an employee. If the employer does not agree with the Human Resources Department assessment of the applicants qualifications, a reply in writing giving their reasons would be required. To enable this system to be effective it would be necessary to require all employers to register their employment needs with the Human Resources Department so that employers can be matched up with available qualified employees.
This system would allow persons seeking employment and/or advancement, as well as employers, an opportunity to be matched up well in advance of the time when permit renewals are required. At present employers are required to publish ads in the newspaper. If a person seeking a job inadvertently misses the newspaper ads he will not have a chance to apply for the position. With this proposal a person seeking employment will have ample time to apply for any job which is, or is going to be, available and the employer can be certain that he has not overlooked anyone locally, who is qualified. By having the Human Resources Department evaluate all applicants, Caymanians can be assured that they will be treated fairly.
This plan would make the newspaper advertisements unnecessary.
The question then is what will happen when the Human Resources Department feels a person is qualified but the employer disagrees. At this point binding arbitration by an all Caymanian arbitration board would settle the issue. If the employer still does not wish to hire the employee a Work Permit will not be issued for the period of time that the work permit was being sought for.
