Because a government cannot effectively ( well, rarely anyways ) enforce drug laws WITHIN the constitution. Isn't that what the 9th amendment is all about? So, let's say that the 10th amendment allows a state government, respectively, or the people, make drugs illegal... They would have to do it within constitutional means. Not only that, but it would have to be by effective means. I'm also not a huge fan of states' rights. I'm much more into individual rights. I think individuals and groups of citizens are far more capable of fighting drugs compared to a constitutionally-bound government. An armed citizenry is the best DEA I can think of...

Besides, I used to work with two individuals... one was a drunk, the other a coke-head. The coke-head was FAR more civil, FAR more freindly, and FAR more under control than the moderate drunk who was nothing short of an uncivil, unfriendly scoundral. The ONLY drug I have seen to have worse effects on people than alcohol only applies to about half of the time... that is heroin.

So no, I don't think it is possible for a government to constitutionally enforce ( effectively ) drug laws, therefore, in my eyes, in hand with the 9th amendment, no government of any kind has the right to do so. If anyone has reasoning for supporting state/local governments' rights to make drugs illegal, please make them known to me!!! I really would be interested to hear them.
