Conflict of interest, claims adviser WORKS, Transport and Civil Aviation Minister Don Polye’s lawyer Paulus Mopa Dowa is the chairman of the newly created Accident Investigation Commission. Mr Dowa, who is defending Mr Polye in the election petition filed by runner-up and private lawyer Alfred Manase for the Kandep Open seat, was appointed at the recommendation of Mr Polye. Former pilot Minson Peni is the deputy chairman while former parliamentarian Nahu Elizabeth Rooney is a commissioner of the Commission. The trio were appointed for a period of five years effective from June 25. The AIC’s Commissioners appointments were gazetted on July 15. An opposition adviser said that the appointment was a clear conflict of interest situation given the ongoing election petition in the National Court. “Everyone knows Mr Dowa is Mr Polye’s lawyer and this is a clear cut case of you scratch my back, I scratch your back,” he said. I don't think Paulus or any other lawyer would have been guranteed a job for defending someone when he or she is paid to do. Paulus is simplying doing his job for his business and he should not be denied of any other opportunties like this one. It wouldn't be a problem if Paul Dowa wasn't the minister's trial lawyer but since he is.....there is definitely a conflict of interest and that in itself is corruption in one form. Without any doubt there is obvious indications of Conflict of Interests, but that does not ultimately mean someone could be practicing corruption. If the lawyer qualifies and has a track record of quality work produced to serving his clients, then like anyone else he earns equal right to be seen fit for the job he's appointed for. On the part of Polye there may be a degree of corruption, but that is yet to be proven, until after such time the lawyer has served that office. But then again, without a doubt anyone on the streets would indicate there is a sense of "Conflict Of Interest", given the fact that the lawyer is currently serving Polye for his own business's benefit.
