Kandep petitioner files fresh motions

THE election trial disputing the win of Don Polye as Kandep MP continued on Friday with petitioner Alfred Manase filing two new motions.
Manase is seeking, in the first motion, an order to summon election officials to give evidence. He is also asking the court to reconsider an earlier decision to strike out certain parts of his petition on competency.
In the second motion, Manase is seeking contempt of court proceedings against Polye over alleged threats made to two of his witnesses.
Lawyer Paul Mawa, for Manase, submitted that Henry Kyakas, the election manager of Enga, assistant returning officer Leo Talipen, and four presiding officers be summoned to give evidence.
Mr Mawa said the officials were on the ground during the elections and knew what happened.
However lawyers Paulus Dowa and Ray Williams, representing Polye and the Electoral Commission respectively, objected. They said these officials should have been summoned during the pre-trial conference.
