Lawyer David Tambili was advised that when making an application to seek court interim orders, his client’s claim must be accompanied by a pertinent provision of the law. This was especially when it involved something “serious” like attempting to stop the Electoral Commission from doing its work. Justice Sevua told Mr Tambili that there were already five election petition cases pending in court and that they needed to be dealt with quickly before polling begins. “Why should the court waste its time on an applicant seeking relief if it failed to cite pertinent laws to back its case?” he asked. The petition, which was in the form of an urgent application, was filed by Peter Komiti, a candidate for the Kompiam-Ambum open seat in the Enga province, who is asking the court to restrain the Electoral Commission from using the updated common roll in his electorate. Mr Komiti wanted the updated common roll nullified and that he had claimed there was anomaly in the updated voters’ list because 7,583 names had been added to it. He also petitioned the court to remove returning officer Luke Waiyon and be replaced by his assistant Herman Yongapen. A hearing had been set for Thursday to look into the case before another judge. Mr Komiti had alleged that current member Dickson Maki and a former member who is running for the same seat had connived to pad the voters’ list with “ghost names”.
