These Supplementary Conditions of Contract form part of the Conditions of Building Contract and shall be read in conjunction which the General Conditions of Contract which are the “ Schedule of Conditions of Building Contract (Standard) Form of Building Contract) for use in Hong Kong, Private Edition (Without Quantities)” issued under the sanction of The Hong Kong Institute of Architects, The Royal Institution of Chartered Surveyors (Hong Kong Branch) and The Society of Builders , Hong Kong - Second Edition 1976 (May 1979 Revision). Where these Supplementary Conditions expressly amend, vary or affect in anyway whatsoever the application or interpretation of that which is contained in the General Conditions, the General Conditions shall be amended, varied or affected and where any ambiguity, discrepancy of conflict arises between these Supplementary Conditions of Contract and the General Conditions, the Supplementary Conditions shall take precedence.

The words “ Architect" , “ Architects", “ Quantity Surveyor", and “ Quantity surveyor's" as appeared in the Conditions of Contract are hereby correspondingly replaced by words “ Architect" or “ Architects", and “ Architect" means K.A. Kho & Associates Architects & Consultants Limited.

“ The said parties hereto accept the Amendments to the Conditions of Contract as listed in the Supplementary Conditions of Contract."



Delete sub-clause 1 (2) of the General Conditions of Contract and replace by the following: -

All the Contract Drawings, Specifications and these Conditions are deemed to be mutually explanatory and if the main Contractor shall find any discrepancy and/or divergence between these documents, he shall immediately give to the Architect written notice specifying the discrepancy and/or divergence between these documents, he shall immediately give to the Architect written notice specifying the discrepancy and/or divergence and the Architect shall issue instructions in regard thereto.

No such instructions shall be deemed to be variations for the purpose of Clause (11) of these conditions.



Replace the whole of sub-clause 3(3) of the General Conditions of Contract by the following: -

As and when from time to time may be necessary the Architect without charge to the Main Contractor shall furnish him (unless he shall have been previously furnished) with two copies of additional specifications, descriptive schedules or other like document necessary for use in carrying out the Works. Provided that nothing contained in the said specifications, descriptive schedules or other documents shall impose any obligation beyond those imposed by the Contract documents named in sub- clause (8) of clause 3 of these Conditions.
