Just to clarify, I am not advocating an "anything goes" situation. As you see from my letter, I am recommending a review and rewrite of the covenants. What I didn't explicitly mention, and maybe should have, is that in the meantime we should maintain the status quo of what has/hasn't been enforced.

One of the problems that could come up, is if the board moved to enforce some things more restrictively, there could be a good case made by residents to fight any enforcement based on precedence and selective enforcement. Any such fight could cause the association lot's of money and/or force strict enforcement of all covenants. I firmly believe that would be an ugly path to take.
