Date Posted: 06/30/04 2:29:18pm In reply to: Mark Schwab 's message, "Re: joke:" on 06/29/04 12:30:34pm Mark: Thanks for taking the time answer me. I have always respected most of the guys in that club. But according to artcile IV of the clubs bi-laws states: ARTICLE IV: MEMBERSHIP 1. CHARTER MEMBER WILL BE A FOUNDING MEMBER BEFORE MARCH 28, 2003 2. REGULAR MEMBER WILL BE A PERSON JOINING AFTER MARCH 28,2003 3. ALL MEMBERS SHALL HAVE EQUAL STATUS AND VOTING RIGHTS WITH THE CLUB INCLUDING HOLDING OFFICE, OWNERSHIP OF EQUIPMENT AND OPERATION OF CLUB 4. MEMBERSHIP DUES FOR THE PULLING YEAR SHALL BE PAID BY APRIL 1ST OF THAT PULLING YEAR. 5. DUES AMOUNT IS SET AT $50.00 PER YEAR PER TRACTOR It does not state or separate paying members and non-paying members. And Mark I have plenty of Law experience, event hough you know me as a child care provider. I have a degree in law and working on my second. I want you to know when it comes to law or bi-law which ever the case there is no such of a thing as implied law. So by what you stated that "member". A person is only a "member" if his annual dues are paid. If he has not paid his dues he becomes a "was" charter member, founding member, or regular member whatever the case may be, instead of an "is". This is true in any club that I have been involved with. On the EMTPA.org website, the names of "charter" (founding) members are included to give recognition to those who had come together in the beginning to form this wonderful organization. Some people on that list are no longer members of the club (i.e. have not maintained their membership by paying their dues) and thus have forfeited the privilages the bylaws grant." That is what your understanding of the bi-laws are from a legal stand point that is not the case and that Mark is my point. I have taken no offense to your post. I appreciate you explaining your view point. And I want you to know if Dan would have left Jerry alone. And not make his comments I would not have made my post. Chuck and Jerry have been pulling for years and enjoy most of the members of the club, but when push comes to push they walk away because they are not going to fight with anyone. That is what they have donw. Chuck does check the site to see if he may want to pull some where closer to home. But that is all. Jerry have not said anything about the club never knew about the post until I posted it for him to read. Thanks again Mark for you understanding.
