Even without considering whether the evidence is really equal on both sides or not (ie, disregarding the system of belief of the observer), the fact that two groups of comparable strength exist who think the balance of evidence is tipped to their own side points to a fair obervation that their choices are of comparable strength, no one choice is clearly better than the other. Therefore, the decision to choose either is not wiser than choosing the opposite option from a fair observer's view. From that perspective, the choice is an Arbitrary Choice.

The situation is like an argument between a group of orange-lovers and a group of apple-lovers. A fair observer will conclude that the choice of either group, although both groups think the balance of evidence is tipped to their own side, is an Arbitrary Choice.
