Subject: Drama... long post

Ok, since the board is dead I'm going to post the drama that's going on, and maybe someone can offer me an idea of what to do.

I had my Partylite party back in November. Supposedly, the orders totaled over $600 and I was supposed to get $200 in free merchandise. There were only 2 things I wanted, and they added up to about $117.

One of my friends (I'll call her Jane) wanted an item that cost $75, but couldn't really afford it because she had already bought close to $200 worth of stuff. I didn't want anything else so I told her I would get the $75 item for her as a house warming gift since it would be free. Additionally, I was told since there was over $600 ordered I could get 3 items at half price. Jane ordered 2 things at half price, and my SIL ordered the 3rd item. Everyone got their stuff, and everyone was happy... until December 13th, when Jane's ATM card was charged with nearly $600.

Jane called me up crying, and told me what was going on. She had just written her first mortgage check, and was afraid it was going to bounce since Partylite took an unauthorized amount.

The sales consultant and I went to the bank with the receipts from the party to show the bank that the amount wasn't authorized. Even with that information, the bank said it would take about 90 days to investigate before they could reverse the charges, and they would have to put a stop on the ATM card, etc. Jane sucked it up, just decided to wait over the weekend, and call Partylite the next Monday to see why they had taken out the money.

Monday comes, both Jane and I call Partylite. Turns out that Jane's ATM card was charged for my SIL's cash order of $153, and another friend's cash order of ~$90. The hostess order, which was supposed to only be $110 with all the half price and free stuff, had turned into an order of ~$250 because the sales consultant made an error on the total ordered, and how much the actual free amount was. Instead of getting $200 free, I was only given $125 free with 2 1/2 price items instead of 3.

So now, almost a month later, the $153 charge has been reversed, and the ~$90 charge has been reversed. Jane had decided to return everything she bought, but since the people at Partylite were so nice to her she decided she'll keep one thing. So we called, and they're sending an RMA to return the merchandise.

The last catch is Partylite said the items on the Hostess order ($125 + 2 1/2 price items) can't be returned for full credit, you can only have a gift certificate as credit. What we thought was going to only cost $25 is now going to be $125 extra. Does this sound legal to you?

They stated if we wanted a full refund we'd have to get it from the sales consultant. It was the sales consultant's errors who landed us in this whole mess anyway. I feel like Jane or I will be forced into buying something for $100 more than we had planned on paying. If this had happened at any retail store we would receive full credit. So I'm wondering if any of you have any thoughts on what I can do.
