The gateman killed her so he is "the most responsible" for the actual death.

The baroness broke the law of the baron, which she was aware of, and suffered the consequences. She chose to put herself in the position to be killed. In our time, yes, the baron and gateman could be charged for the murder, but the baroness did bring it on herself by disregarding the rules given to her.

If you were to walk up to a police officer and punch him in the face, you know you're going to go to jail. Who is responsible for putting you in jail? The police officer. Even though you are aware of the consequences you still choose to do them or not. So you are the one to be blamed for what happens to you, but ultimately the consequential act is done by the police officer (or gateman).
