The bar my sister used to work for is in a little bit of trouble in light of the Dram Shop Act. Here's the story, followed by the question of liability. A stupid fuck and some of his friends (lets say 4 in total) went to this bar and had an unhealthy amount of drinks. They were never cut off and the bouncer says that stupid fuck was visibly intoxicated when leaving the bar. PA law states that you cannot be served alcohol while visibly intoxicated or face the consequences. Um yeah, I'm speechless too because well look at us...I've never been cut off. Anyways, stupid fuck proceeded to drive his vehicle, crash/hit and kill someone. Now, Hafer, before you get all answer happy, allow me to finish. Stupid fuck is facing 9 to life for being a stupid fuck, and also murder (in the general sense). Father of stupid fuck is threatening to bring an action against the bar for serving his son way too much alcohol. They have the bar receipt, with a long list of drinks. Knowing that the dead person could probably sue the bar, and that the bar is probably liable to any injury the stupid fuck caused to himself, what damages would stupid fuck be entitled to? How difficult is it to prove the visible intoxication issue of the case? What good is monetary damages if you're in prison for the rest of your life?

Don't drink and drive kids.
