This was a quite correct application of the law as it reads in most
jurisdictions around the country. These Defendants are merely trying to
perpetuate a ruse upon the courts and the judiciary, and fortunately our
systems are prudent and reasonable enough to "weed out" these bogus defenses.
And if this young woman actually did fear for her safety, she should carry a
cellular phone with her and call the police at 911 as others have done before
her, pulling over for the officer while doing so, of course, and surely
eliminating many of the more serious charges against her. Possibly the court
would deem that DMV should retest her for her license privileges and/or she
should be psychologically tested for her fitness to operate a motor vehicle
in that state, discerning the differences between right and wrong, etc. $500
fine, suspended upon successful completion of a driver's education course
approved by the DMV, retesting and, as appropriate, re-licensing by the DMV,
court ordered psychologically testing and counseling if deemed necessary by
the proper authority, and points assessed for each moving violation, along
with a 2 year probation conditional upon successful completion of all of the
foregoing terms and conditions.
