Subject: Mulder's next-of-kin

After watching "Requiem", then rewatching "The Sixth Extinction" and "Amor Fati", a question has occurred to me. Remember in "TSE" when Fowley was trying to block Scully's access to Mulder, then in "AF" when Mrs. Mulder allowed CSM to take Mulder away?
Well, what if Mulder returns from his alien abduction experience in *REALLY* bad shape? Who decides what kind of care he gets, who has access to him, etc. As of "SUZ", he really doesn't have any immediate family members left to make medical decisions for him if he's incapacitated!
I've got a couple of theories on this which I'm listing in order of what seems most likely:
1.) In the absence of other immediate family members, the fact that Scully is pregnant with Mulder's baby, combined with the fact that other people (like Skinner and the Gunmen) can testify to the fact that she and Mulder are long-time "partners" (in whatever sense one chooses to use that word), I think she could probably get some sort of court order declaring her the person allowed to make medical decisions for him. The court would, in essence, rule that their long-standing partnership and conception of a child together had given her the status of a common-law wife.
2.) The doctors would attempt to find some family member, no matter how distant. Unless Bill and Tina Mulder were both only children, I would presume that Mulder has an aunt, uncle or cousin still living someplace.
3.) The doctors would simply make all decisions themselves.
4.) Scully will whip out a marriage license to prove that she and Mulder got married sometime during Season 7, but CC just forgot to tell us about it!
Actually, I hope the question never comes up! Given the fact that Mulder spent almost all of three different season 7 eps, (TSE, AF and Brand X) in a hospital bed, combined with the fact that he's only going to appear in half the eps next season, I *REALLY* hope that he's found healthy and rarin' to go!
