Mr David,
Contract law supercedes all other law. The Uniform Commercial Code is the international law. That is the only way countries could do business with one another. If there was a dispute which country's laws would be used to resolve it? In the US contract law is more powerful then even constitutional law.

If you violate a non-proprietary disclosure agreement with a former employer on the grounds of first ammendment freedom of speech, who do think the judge will side with?
Contract law will win each time.
