The burning question from this episode: Does Mulder know right from left?

He tells Scully that Max has a scar behind his left ear, even though we've just seen Mulder take a peek behind Max's RIGHT ear.

I think this was a pivotal episode for Mulder. He learns, through Max, that there are others out there who believe as he does. With or without the FBI, Mulder knows he can - and must - continue his work. I think this was his motivation for taking a strong stand at the professional conduct hearing.
