First, it won't be called an XXX site. It will be called a free-speech site, or something along those lines. As long as there are proper disclaimers (i.e., "over-the-age-of-consent" for certain sections, "not-responsible" for the entire site), there are no difficulties involved with "obscene" material, especially since it's mostly text. Links to images should not be a problem as long as the disclaimers are there.

See above. Regardless, the only personal details necessary in owning the domain are a billing name and address. Depending upon the domain host, those details are always kept strictly confidential between customer and provider, so most background checks will never reveal such information. (Security clearance background checks are another matter.)

It does, but I contend that the benefits far outweight the problems.
