Fair enough. And granted, a judge can be biased against the prosecution. However, if you were (and maybe you were) in the courtroom for the trial, you could have judged the conduct of Mr. Fieger for yourself, and viewed the responses of everyone in the courtroom also. Were you aware that the jury laughed at him? Some of his antics were absolutely comical. Is that what it takes to be a good lawyer? Does that make the judge biased because she won't allow all of his childish comments? Does that mean that a guilty verdict should be overturned because of his unprofessional conduct? Perhaps if one could prove that Fieger was incompetent, then you could motion for a mistrial due to your lawyer's gross misconduct or negligence. But let's remember one thing--"they" picked Fieger because supposedly, he's the best of the best. And he may be. Hell, when the Dr. Death trial, and retrials, were ongoing, I thought he was unstoppable.
My overall point is this: Even if the verdict is overturned on appeal, even if the next jury AND judge views Fieger as a saint, what new evidence is there that will make a difference? Maybe the stains on Markus's pants were not examined closely. Maybe Nan wasn't the greatest person to either of them. There's still no smoking gun, and nothing that, I believe, will convince a jury that Ralf is not the killer.
And, mark my words, if there is another trial, there will be things that Fieger will not be able to get presented in court. So will that make the next judge biased also?
