As salaamu alaikum

I'm a posing this question for a sister that recently embraced Islam. Before accepting Islam she legally married by the state only a muslim. Their marriage was also performed by a minister. Her "husband" is currently serving a 40 year sentence in prison as well. She wants to know if her marriage to him is valid according to Islam since she is now muslim and if she is able to remarry now. BarakaAllah feek.
