Subject: Kia timing belt destroyed my engine-- warranty won't cover it

I have a 2001 Kia Rio with 72,000 miles whose engine was destroyed by a timing belt that was not replaced by the Kia service dept. I went to them at 59,000 miles and stated that I wanted them to do everything necessary to keep my warranty intact. Kia's position is that because I didn't say "replace the timing belt" I am liable, and the powertrain warranty won't cover the new engine-- a cost of approximately 4100 dollars according to the dealership, and 2000 according to my local mechanic. I am in the process of researching the Magnuson-Moss federal warranty act to bring a lawsuit against Kia for failing to honor its warranty. Any advice would be appreciated.Thanks.
