Subject: Telephone calls today Supreme Court Investor Relations--ERG
Comments:

Rang the Administrative Appeals Division, Supreme Court N.S.W. and had a few questions to ask regards what a "call for directions" entails.
The person stated that the court was quite "choc a bloc" at the moment and if after appearing before the registrar, it was a long matter that needed to be heard, he said in his opinion, that a hearing date would be more likely to be June July. (as they are choc a bloc full till May) If it was a matter that only took a couple of hours to decide he said the registrar may decide more like April May. Both sides have to be consulted with and from that and the factors above, a date is set. Asked him further could the case be thrown out? He said that is possible if one side stated a discontinuance, thats about all I asked him, that being the case flowing from that, the whole thing could be resolved Feb 6th, at this stage though if a discontinuance does not happen, the bloke I spoke to is saying more like April May at the earliest.
Further, have just finished speaking with Sean Duffy, (he won't give me a view on NTA--(lol) he confirms that all paperwork has been submitted and ERG are waiting to hear from N.S.W. (I quoted the SMH article to him) he has stated at this stage the financial report will be the 1st week of March. He said with the court case as I had ealier learn't off someone who has some legal training had stated, the case between N.S.W and Cubic does not stop N.S.W. signing the contract with ERG. (They do not have to wait for the outcome of N.S.W. verses Cubic. in order to proceed.)
Regards,-WW.
