Let's say your dogs are the best rabbit dogs in the world, or the fastest racing dogs or they've won awards for being the most cuddly dogs in the world, no matter what they are the best at, (or among the best at), your dogs are some of the most sought after dogs in the world. They are your dogs, so it is absolutely your right to put them in the homes you choose. Now let's assume that you've placed dogs/puppies in all your relatives and all your friends home that want one of your dogs/puppies. The people left who want your dogs are not your friends or relatives, (you don't know them). People are sending you emails and calling you on the phone asking when you're going to have more puppies available to 'a good' home. Certainly you 'try' and weed out those who do not sound like the type of person you want your puppies to be placed with. You still have more prospective 'good' homes than you can provide puppies for. The people you think will provide the type of home that you want to place your puppies in say to you, "I really want one of your puppies, I'm willing to take the extra step, I'm willing, I want to place a deposit with you in 'hopes' that you 'may' have more puppies available to be placed in a 'good' home like mine." What is the fairest thing here. You have multiple 'good' homes to place upcoming puppies in, actually more homes than puppies. Some of these homes/people 'voluntarily' say they will place money down on a puppy for the 'opportunity' to have one of your puppies. It seems to me, (all else being equal, quality of home, etc), that the people who are willing to place that deposit has demonstrated in one more way that they are deserving of having one of your puppies. Now this is me, Jerry, speaking, "I would agree that if the breeder was unable to produce any more puppies that the deposit should be returned, however if the breeder complied with all her/his responsibilities and the buyer backs out, the deposit should be kept. Of course it should be made abundantly clear in the beginning that the deposit is not refundable unless it is the fault of the breeder that prospective new owner did not get a puppy. Regards, Jerry
