    Residential Condo rental - Lease signed at Real Estate Office by Tenant - (Agent acting on behalf of Landlord accepted rent, security, etc.)
    Tenant moves in - Infested with ants and disrepair-
    Speaks to Landlord Day #10 after move-in -
    Tenant receives call from RE Agent same day to move-out - Landlord does not respond to 7 day notice, Landlord issues Eviction Summons:

    Questions: Contract/Property and LT Law:
    What laws support Lease agreement contract is valid? Effect of Unsigned Lease.

    Is Retaliatory Eviction a "criminal" offense? ? Past cases decisions?

    If damages are not recovered at Eviction hearing, what others legal avenues should the Tenant pursue (after Eviction proceeding at Civil Court)?

    Can both Landlord and Real Estate Agent be found quilty of "breach of contract", fraud, "bad faith" etc?

    Im currently filing for a divorce. I am 4 months pregnant. My lawyer told me that I could NOT start anything for custody (for future when my baby is born) until the child is born. Because the fact they cannot legally concider and unborn child as its own "person". So its a simplified divorce. We both want it. Why on earth do we have to take Divorce and the impact on children course? I talked to a lady who does the registration and she told me that she never had a situation like this before. Also let's say I took this course 3 years ago, could I possibly use this certificate as proof for my case now? Or who could I go to to find this out? (I want another opinion not from my laywer)

    I CO-OWN A TIME SHARE IN FLORIDA, WITH MY EX-GIRLFRIEND BUT FOR THE LAST 9 YEARS I HAVE BEEN THE ONLY ONE PAYING FOR THE UP-KEEP AN ETC... I AM TRYING TO FIND THE LAW THAT WILL GET HER OFF THE LEASE SO I CAN LEAVE MY KIDS THE TIME SHARE IN MY WILL. I DO NOT KNOW WHERE SHE LIVE OR ANYTHING CAN ANYONE POINT ME IN THE RIGHT DIRECTION ONE LAWYER TOLD ME THAT I CAN NOT DO ANTYHING IS THIS TRUE?

    Heres the thing. My brother is 18 years old, but still in high school. My mother and her husband have kicked him out. I would like to know if Florida has laws where a parent must provide housing for the child until they graduate high school, of course Im sure the child may move out voluntarily at any time, now that he is 18, because I did it. But for some reason, I have an inkling that she is in the wrong and can't legally do this to him. The worst part of it is he has no place to go, and she doesnt care that he could possibly living on the streets. So I am intervening, trying to keep him home until he at least has somewhere else to go. If someone could help me out, I sure would appreciate it.

    I HAVE A SON WHO IS IN PRISON. HE HAS A DETAINER ON HIM FOR AN OUTSTANDING MM WARRANT. HE HAS NO IDEA WHAT IT IS FOR, BUT THEY WILL NOT SERVE HIM IN PRISON. THEREFOR HE HAS A DETAINER ON HIM WHICH MAKES HIM INELIGABLE FOR WORK RELEASE OR ANY OTHER HELP HE NEEDS. THERE IS SOME KIND OF MOTION HE CAN FILL OUT GIVING THE COURT 90 DAYS TO PROSCUTE OR DROP THE CHARGES. DOES ANYONE KNOW WHAT MOTION THIS 20 YEAR OLD NEED TO FILE SO THE COURT MUST ACT NOW ? PLEASE HELP ME IF YOU CAN. THANK YOU SO MUCH. DONNA

    My daughter has lived with her boyfriend for 13 years, she wants to move our but is worried that he will not allow her to take things they acquired together during these years, does she have any rights at all, if he refuses to let her take even her stuff, can she get a police officer to accompany her to the residence to remove stuff?

  • Need help removing a tenant -- Rachelle, 22:05:33 03/09/06 Thu
    Here's the deal. I entered into a contract with a girl to sublet my "spare" bedroom and the second bathroom. She presented herself as being of legal age. I have since found out she is only 17. I'm sure she is not a run away as she talks to her mom on her cell phone all the time. She has started cursing and calling me names in front of my 19 month old and she has also started slamming doors, and the framing on her bedroom door is coming loose. I am desperate to get her out of my house becuase I fear for my daughters safety. She 'said' she was leaving by the 20th, but she didn't put it in writing and when I try to talk to her shhe ignores me. Also.. I don't know if the contract is legal since I found out she's only 17. In the contract it states that she has to give me 15 days written notice (I'm trying to get that from her), and that even if she leaves early, she still has to pay for the entire month. The last day she is allowed to stay in the entirety is the last day of June.. but I did not put in there that she HAS to stay until then... Actually the whole point of the duration of the contract was that she can leave just about any time with the 15 days notice and that there was no real penalty for leaving early... like how some places make you pay for another month if you leave early even with notice. Can I legally tell her at the end of the month she HAS to leave.. aka if she tries to pay me, refuse her money and tell her to get out. Can it be considered tresspassing if she stays? I need to do EVERYTHING I possibly can to get her out of my house! PLEASE help!!!

  • Small Claims Suit Witness List -- Kathy, 23:36:58 03/05/06 Sun
    In a small claims suit, must a defendant's witnesses be allowed if the list furnished had witnesses listed with first name only and no additional info. such as address, etc.? Also is defendant allowed to call witnesses that were listed with wrong names or listed as "Jane Doe (AKA Mary)" with no other information? Is this legal for Discovery purposes to the Plaintiff?
