    I am down her from Ga helping appraise the Whilma damage as an independant appraiser. I am in a hotel and asked to extend my stay until Dec 15th and they said I have to leave.I have a major insurance Co paying for my room on a CC. Can they force me to leave/evict me if I am paying.

  • How Long For a Bill To Go Into Effect? -- Brad, 21:02:16 01/23/06 Mon
    Hey guys, I'm not very good with Law, but I had a question about Bills in Florida.

    As you may or may not know, Slosberg (a South Florida Representative) recently proposed a bill to raise the driving age from 16 to 17. I get my permit in less than 20 days and then have a year to go until I would get my license. I am concerned about whether or not this bill will go into action or not fast enough to affect me getting my license on my 16th birthday, as it is something I have been looking forward to since I was 10 years old.

    Does anyone know how long a bill like this would take to go into effect, and if I would be exempt since I would already have my Permit?

    My husband was arrested early Sunday morning on charges of domestic violence. (he did grab my arm) The judge put into effect a no contact order. Well, I obviously I live with my husband which "I" had to leave our home. (i have a sister i can stay with and he has no one) I am 2 months pregnant with his child. I know that the state picks up domestic violence charges but can i get the no contact order dropped? If so, how likely would it be dropped since it was court ordered?

    I went before a judge on 11/23/05 to plead my side of why a default judgment against me should be set aside.The motion was granted. The judge gave me 20 days in which to respond. I am having difficulty finding what to do next.

    The suit involves a hospital suing me for money over an emergency room visit, in which I was grossly overcharged and under-served. This, I can proove, but I don't know what the next step in the procedure is, or where to find the information I need to follow procedure to represent yourself. Any suggestions??

    I'm preparing my Will, and when naming my daughters guardian, I have a few concerns. She hasn't seen her father or heard from him in years. Can I name another guardian?     if a person has a felony conviction 35 yrs ago and fills out a job app. does he or she have to declare this or is a statute of limitations in place. the crime was armed robbery but the person in question was only a acessory and has the transcripts to prove it,the judge say, that he knew that the person was not a moving party in this crime but he could not let it go un-noticed. the sentence was 6mo. to 5 yrs. and the person was released in 12 mo.
    my question is this,do you have to report this on your app.? why would a person want to keep stiring this pot when no crimes have been commited since. what happened to rehabilation? I don't feel that after all these years and no addional crimes have been committed that one should have to keep paying for their mistakes made 35 yrs ago. what is the law on this if their is one?

    the condo board decided 3 years ago to chanege to no renter.according to our by laws you need 2/3 vote of owners. I was not notified of vote or given a proxy. Then I was told my vote was not needed because they had a 2/3 vote with out me. Can they do this, or should there be another vote ? Thank you. your help is appreciated please e mail me.

    Hello. I was recently kicked out of my gf's house for circumstances I can't get into right now and was not allowed to return and get all my things due to a restraining order-I was only allowed to get clothes, etc.

    I found out the police have seized my computer in relation to this investigation. The computer is 100% mine and I was not allowed back into the home to retrieve before it was seized. I have not been presented with a search warrant for seizure and in fact have not even been questioned in relation to the charges, which I also do know the extent of those charges. My question is this-can the police seize my property legally without serving me with a warrant and in fact not even contacting me about an investigation? The computer was in her house but no part of it belonged to her, and I was unable to get it due to the injunction. Can I fight this seizure?

  • Can you violate your own restaining order? -- Michelle, 03:31:19 09/12/05 Mon
    I finally got a restraining order on my youngest children's father. He has abused me in everway possible 6 out of 61/2 years of a so called relationship. I finally broke away free with my children and my life 8 months ago. Well, this guy was free of drugs during most of our relationship(5 yrs as of last December)until he decided to go out on me with my so called best friend. This friend and he used drugs the night they spent together and then he was off to the races,the crack house races on his crack cocaine induced binges. Sometimes days,weeks,months, whatever! Anyway, I got my order of protection finally after trying to for 2 1/2 years. Well, through some old neighbors, I heard that since I left he was going down hill real fast. I have twin toddlers by this guy. I also have a 15 year old who is not his but now hates him, can you blame him? After hearing how fast he was falling apart I, like an idiot, contacted him to see if I could talk him into going to get some help. I got caught around him but never got charged with violating my restraining order by the seargant. Long story short, I convinced him to go into inpatient treatment and had some of his criminal charges of battery and flase inprisonment lowered if he agreed to do so. The state's attorney agreed. Well, he goes in, but before he get's transfered to the facility from the jail he writes to me to my PO Box address. I responded twice. Then after he got transfered he kept writing and writing things I've been longing to hear for so long that I'd cry my eye's out. Don't worry, I DO NOT long to be with him ever again, it was just stuff I think I needed to hear to be able to move on. I am in intensive counseling for being a battered woman and I am strong in many ways now that I wasn't before. But what I did is, when he first got into the facility, I wrote 2 more letters. In them I said stuff like, you don't know how long I waited to hear those words of how sorry you are and how I at that time was looking forward to those stupid letters. He would tell me that if there was no chance of an us again that he wouldn't waste his time in this treatment center, so I lied in the begginning and told him some of what he wanted to hear. The only reason I tried to help this guy even after all he did to me was because one day I'd have to face those 2 boys when they got older and asked " Mommy how did our daddy die"? & "Mommy how come nobody tried to help our Daddy"? I then told him shortly after on the phone when he called me that I didn't want to hear from him anymore and hung up on him. He wrote and wrote and wrote. Now 20 letters later and about 8 phone calls that I have proof of, I want so bad to turn him in for violating the restraining order because he's just using that drug facility as a get out of jail free card. I know this because during one of his calls I tell him he needs to focus on getting himself better and I the same and he says--stop running that counseling BULLS--T on me! He got sentenced to 11 months 29 days of jail time but was allowed to attend this program to get some help a day for a day and it's a 6 month program. He writes how he loves to sit on the proch and smoke a cigarrette right after it rains and how he gets to landscape and plant flowers and order food from outside and how he'll be getting weekend passes home soon. None of this is a lie because I called and found out all of it is true. I no longer live in our old house that he'll be going back to but I do live in the same town and county. I want so bad to make a report on these violations he made of the restraining order but I don't know if I would get in trouble in anyway because of the stupid 4 letters I wrote to him in the beginning. Can I get in trouble with the law? I was told no so far by 1 Sheriff. I have 3 kids to take care of and to protect so please be correct on your answers. THANK YOU SO MUCH!!!!!! Michelle

    I need some help dealing with my townhome HOA (Home Owners' Association). I thought my monthly HOA fee was being autodrafted but it was not...my fault. I received an "Intent to foreclose" in the mail last week. There was a Claim of Lien already placed. I owe 6 months plus interest and attorneys fees. This was the FIRST notification I have received.

    I'm in need of several answers. My brother and his girlfriend broke up and they have two children. Before there breakup 2 years to be exact the girlfreind filed charges against her step dad for domestic violence. She then filed again in 2004 for the same thing also, against the same person. Since the last injunction her and my brother and there kids moved from Bradenton to Deltona where he currently lives now. A month ago she decided to leave my brother and take the girls back to Bradenton to live next door tocthe mom and stepfather that the domestic violemce charges were filed against. Last Wed. she went to court and the judge denied the injunction and she still lives there. When she left my brother she only took what little stuff belonged to her. Not the girls which are 3 and 1. No diapers, wipes, social security cards, birth certificiates. Only a weeks worth of clothes. Right after she left I received a phone call from my brother stating that the girls were in danger and he needed to get to Bradenton. So I paid for him a bus ticket down there and low and behold her telling him that he could come and see them only if he took her to Burger King. She'll call him and tell him if he sends her money she'll let him talk to the girls on the phone. To make a long story short she wants money in return to maybe or maybe not let him talk to his girls. I've called CPS because of the kids being dirty, and living next door to her mom and stepdad (Brief history on her mom- 2 years ago she was caught buying cocain with my brothers oldest daughter and CPS was called). This time CPS told me that if I file false charges again they will have me locked up. Also living in the house with the mother is her sister which is 13 and her 29 year old boyfriend which is the father to one of her neices. In the last couple of days I've got several phone calls from friends stating that the youngest daughter has either a cig. burn on her cheek or she's been hit, both kids are dirty and wearing filthy diapers. So I inturned called the sherrif's department and they threathen to file charges against me again. I don't give two hoots about the mother or my brother. All I care about is my neices there safty and well being. Me being the aunt I don't think I have any rights. My brother has went to the Deltona courts and filed papers to hopefully gain full custody of both girls. My only problem with that is my brother loves his girls but he's not mature enough to give those girls the life that they desearve. He works full time and instead of staying home and making sure his girls have everything they want or need he inturn will buy video games and computer parts. He has no car and barley makes $8.00 an hour. As a concerned sister, aunt, mother and wife what are my rights? Why won't CPS get involved with this case? Will somebody please tell me what Florida's laws are when it comes to CPS? I live in Virginia and I don't know anything about whats right or wrong when it comes to children and there rights in Florida. I know the laws in Virgina and CPS would take those kids in a heart beat. Please HELP!!!!! Not for me but for my neices...............

    I need help. I am trying to find out how to keep my husband from going to prision for 15 years. This past January, there was an argument between myself,him and my daughter, the law was called, upon the arrival of the law, my husband had a gun, not to hurt us in any way, this gun does not work, it is an antique given to him by his mother when she passed away. The problem is he had a felony aproximately 3 years ago, and didn't restore his rights, well needless to say, he was arrested for possesion of a firearm by a convicted felon. My question is: If the firearm does not work and is concidered an antique can they still use this against him, and is there any statute we can use in his defense for this? We live in Florida, and I hate to see him go to prision just because we all had an argument. PLEASE, if someone has an answer, please help us figure out how to keep our family together. I found in the Florida statutes 790.001 paragraph 6, one thing about antique firearms, but I do not know if this will be enough. Thank you for your help and your replies. They are appreciated.

    Our roof was damaged during a hurricane. The roof was repaired and the house was put on the market for sale. The buyers were aware that the roof was damaged. 2 months after closing the buyers are attempting to collect a substantial amount of money claiming mold in the attic. They had a home inspection, it should have been uncovered at that time. Are we liable for all the costs?

    I offered to let a co-worker stay in my guest room when i heard her say that she and her infant son were having issues getting her current landlord to take care of mold issues in her apartment. But, after only three days, she is starting to move more and more and more of her things into my home, and I am concerned that getting her to leave is going to be an issue. I do not want her in my house anymore, but I fear that I may have already gotten in over my head. Does anyone know what my rights are at this point? Can I just tell her that she has to get her stuff out and leave, or have I gotten myself into a situation that is more involved than that? Any advice would be greatly appreciated!

SINCE THEN MY HUSBAND HAS GONE ON TRIPS & DID EXTRA WORK FOR THEM, THEY MADE AN AGREEMENT TO TAKE MONEY OWED TO US & APPLY IT TO THE TRUCK BALANCE. THE TRUCK HAS SINCE BEEN PAID OFF & THEY TOLD US THE TITLE WAS OUR PROOF OF PAYMENT. MY HUSBAND QUIT IN JUNE 05, NOW THEY R SAYING THERE WAS A MISTAKE ON THE TITLE & WE STILL OWE THEM MONEY. THEY WENT TO MOTOR VEHIVLE & SAID WE STOLE THE TITLE FROM THE OFFICE (WHICH WAS MAILED DIRECTLY TO MY HOUSE) NOW MOTOR VEHICLES HAS SAID THEY R GOING TO REVOKE THE TITLE & REISSUE ONE WITH THEM AS THE LIENHOLDER, THEN THEY CAN REPOSSESS A TRUCK WE ALREADY OWN.     still sends me uninsured medical bills after my child turned 18 a year ago!
