  • encroachment of my property -- Nancy Canty, 20:09:49 08/17/05 Wed
I feel sure that my neighbor has built a shed on my property and fenced in approximately 9 feet of my property several years ago. Before I pay for a survey and hire an attorney I would like to know if there is a law which states there is nothing I can do about this problem legally because of time lapsed. My husband is deceased and I don't need unnecessary expenses if this would be a foolish endeavor on my part. Thank your for your consideration and any answer you may give me concerning this matter.

What is the statue of limitations in florida for reporting a crime where I pleaded guilty even though I didn't do the crime? Ipleaded guilty at the insistence of my attorney to keep from having to lose my job and quit schooling. this was back in early 1980's.

  • FL 3 Day notice to evict, Tenant/Landlord dispute -- Judy Jerichow, 13:43:30 08/13/05 Sat
I received a 3 notice to evict because I had not mowed my lawn.Well, that was the tip of the iceberg. I have an oral lease with my landlord for the past 19 months. I have never missed my rent, and the only time I appeared to be late, was when he picked it up late. He never gave me an address where it could be mailed, so I had to call him , then wait for him to come get it.
I agreed to maintain the front lawn, because I laid the sod. He agreed to maintain the back yard and the vacant lot adjacent to the house. I complained because we had no heat, no smoke detectors, and most of the windows will not open, and the others will not close all the way. The landlord told me hhe would not fix the windows, and told me to stop complaining. The house has 2 wall A/C units. Only one is working now. The one in the back, for the 3 bedrooms, broke last summer. When I told the landlord, he said he would not fix it. Upon moving in here I paid first, last months rent and $300 security. He got tired of me complaining about the repairs that needed to be made, so that brought on the eviction. He also would walk into my house any time he wanted to yelling "MAN ON THE FLOOR". Once I was getting out of the shower, and when I came out of the bathroom he was standing in my kitchen. He asked me to drop my towel. This was not the first, or the last time he made inappropriate sexual remarks to me.
I agreed to vacate the premises. I have paid the rent for August, he wants me out by September, but refuses to give my last month rent I paid in advance, therefor causing me a hardship to be able to move. I need that money to apply towards another place to live.
I went to the court house to contest the 3 day notice, the clerk told me he never filed it.There was no record of any eviction proceedings against me. I dont know what my rights are as a tentant, and would appreciate any advice as soon as possible. I received the 3 day notice on Aug 10, 2005, the next day I received another letter from him stating my rent was increasing by $200 a month effective Sept 1,2005. I was under the impression to increase rent I should be given a 30 day notice?!?! Does anyone know about this?
I am packing my stuff now, because he threatened to put it out to the curb. I would rather it go in storage, and I will go to a hotel if I have to,which I may have to because I wont have the money to put down if he wont give my last back.. Please anyone that can help me. I am open for any suggestions.
    Thanks

  • Florida condo laws -- D Higgins, 18:51:12 11/30/02 Sat
My mother in law owns a condo in Hollywood Fla. The board disapproved sale of the condo to my husband and I due to age restrictions. The board disapproved of the condo to her brother in law. These actions resulted in an on-going law suit. We then attempted to sell the condo to a third party through a realtor. The board disapproved of the buyer and stated in writing it was due to the pending law suit. We live in NJ and our Fla lawyer is non-responsive. Any clues?

well im 16 and just resently I spent the day with my boyfriend you know without telling anybody, the olny reason i did that was because my parents told me and him that we couldnt see each other again. I only have 1 more year left and I dont want to switch schools. So i wanted to know if you get imancipated do you get to choose where you live and do you get to go to the same school. • FL Condo Law - Water Damage -- Owner, 17:08:56 03/21/05 Mon
A water leak occurred in the upstairs neighbor's unit, through no negligence on their behalf - it was an accident. Damage was done to the downstairs neighbor's unit. Neither neighbor has home owner's insurance. Is the upstairs neighbor legally liable for the downstairs neighbor's damages? Or, does each pay for their own damages?

I want to move out of my grandmother’s house and i'm 14. I live in Florida and my friends parents are willing to take me in. the reasoning for me moving in with her is because my grandparents are moving out of town that I have been in my whole life and where there moving is not a very educational and/or good influences for me. I wouldn't be moving till 10th grade which means ill be 15 and starting a new school. In some towns there educational level is different. Now if I was staying here (through my whole high school) I would be going to Manatee and I am already involved in many things that could get me scholar-ships and further in my future. If I were to move it would be to a very bad town where they do nothing but drugs and not get anywhere. Please help me? redhotbubbles123@yahoo.com thank you Christina

Hey. My name is Elizabeth. I am 15 and I can not stand living with my mom. She drives me up the wall but I do not want to go live with my dad unless I absolutely have to because I will be leaving everyone I have known, including my 11 year old sister, since I was 4 or 5 years old. Me and my mom are always fighting and I am sick of being treated like a child. I have a place I could go if I could get imancipated. I just need to know how. I live in Florida. If someone could please let me know I would greatly appreciate it.

  • I need imancipated FAST! -- *Jessica*, 18:52:15 07/16/05 Sat
I want to get imancipated because me and my dad don't get along. i used to be really bad the summer of 2004 but i have changed a lot since then. matured, and grew some self respect. i didn't finish going to Mishawaka High School, i stopped going and then they expelled me for being truant so many times. i'm not proud of it but then they told me that i had to go to summer school so i decided to go and i have gone almost every day except for the days that i had to go to the doctor's for personal reasons. my boyfriend is 19 and he is going to the army and he wants me to go live on base with him but my dad won't let me unti i'm 18 i have been with this guy for almose 3 years in Februaury. I told him that i would do whatever it took to be able to move on base with him and now i'm trying. i have a job at Shoe Carnival in Mishawaka on Grape rd. I start July 24 the day after my birthday. and as far as I have been told you have to be 16 to be imancipated and i will be in 7days. I also heard that you have to have a place to live. Well he's going to be going to the army there for they will already have a place for us to live and it will already be paid for which is better than anything else, i would think. Another thing I was told was that you have to be doing good in school. Well, as far as I'm concerned the army pays for everything like schooling. and if they don't then i can still go to a different school, do good, and get my high school diploma and then go to college. I haven't decided what i want to become yet. I was thinking along the lines of a Veternarian or a nurse. Haven't decided. Thank you.
    Jessica

My 16 year old step-son is here on his summer vacation from Fl. We live in Ms. He wants to move here to Ms. and spend the 11th grade with his father. His mother has refused. They have shared parental responsbility with her having physical custody. She has told him, until he is 18, he has no rights to say what he wants or what is best for him, even if we go to court, the judge will not allow him. Is this true, and should we go further with it? He says he will tell the judge he wants to.

Are verbal agreements binding in Florida? This has to do with a landlord/tenent possible dispute. There is no written rental contract as of yet, only a spoken word agreement. Does the agreement stand?

  • Statute of limitations for bad credit in Florida -- Jodi, 00:14:52 07/07/05 Thu
We had our home phone turned off due to an over due bill from Verizon. After a few days, I called Verizon to check the balance needed to get our phone turned on again. The Verizon clerk told me, we discussed some other issues, such as my DSL subscription, keeping the same number and when and how I was going to pay. She gave me a conf # to have when I paid the bill in full. After about a week the bill was paid and I called Verizon within a day because the phone was not on yet. After speaking to a couple of different people and feeling I was getting somewhere, the clerk I last spoke with told me that the Statute of Limitations for Bad Credit has changed in Florida from 7 years to 10 and that I had a balance from 1997 for over $300.00!! She said I would have to pay that to get the phone service back on again!! Help!! Does anyone out there know about this new law and can they go backwards on us "common folk" out there struggling to get ahead? I was totally blown away by this new law and now I'm REALLY wondering about the Bush admin. and his brother, what's going on??????

My mother planned on relocating from her Florida home (condo) to another state after a needed operation to lift her bladder. A neighbor was interested in byuing her unit and she bought a real estate contract at a local office supply store. A deposit was made and the contract papers were signed on 6/28/05 with the specification that the closing date would be between 8/15/05 and 8/30/05, time enough for her to fully recover. Her operation was yesterday and her surgery was not completed, they had found cancer. She needs to stay local for her needed treatment but we are currently unsure of the extent and timeframe needed for recovery. Can she cancel the contract to sell her home since it's has not yet been 3 days?
