I am still finding that my case is coming up when background checks are ran. I thought that since the adjudication was withheld that the I would not be found guilty of the crime.   • Landlord Issue -- Christina (HELP!!!!!), 07:54:24 07/15/10 Thu
    I have a roof that caved in 2 mths ago and left a huge hole and by huge I mean it is a good 4x4 in addition I have now been invaded by red ants through out my house mainly in the master bedroom. Everybody has been sick in my home due to toxic mold spores from the damaged roof and both myself and husband are covered in ant bites. The landlord was notified the same day of the roof caving in and that was 2 mths ago. He resides in Canada for another couple of mths and I have no way on contacting him he has some friend of his doing his dirty work while he is away. I woke up this morning only to get a knock at the door for an eviction notice that I was served. I have not paid rent since the roof caved in nor will I as long as I can see daylight through my roof. The landlord was notified not only verbal but in writing as well. My husband and I do not have the funds to move due to the fact that we do not have medical insurance and all medical expenses were out of pocket. Please help do not know what to do.

    Custody case 2 months after trial judge admitted he could not recall the case asked for a synopsis in person from the lawyers and then awarded custody to the father of my child because it was the parenting order in front of him the father took her withheld her from me and is abusive. I am concerned about the decision made and I believe I should have the right to have this case addressed again. I have a hard time believing that the systems cares so little for a child.

    The facility that my son is in has horricially been abusing him "to break" him and have told me that when they are through with him he will grab his ankles and ask for more. They also told me that they could kill him and I could do nothing about it. When I protested they then told me that they could kill me and no-one could ever touch them. They have abused him for 3 years and when I wrote the warden a letter and told him that I would bring to light the numerous infractions within the prison operations if he did not transfer my son. On my next visit I was drug into a admin building and told I was being charged with conspirasy to bring drugs into the facility. I had my auto searched and then had to subject to a full nude body cavity search and of course they found nothing. My visitation and phone priviledges are now permanently suspended and my son is in isolation being charged with the same thing. This is a ridiculous charge and they picked two sentences out of our phone calls over several weeks that were about something totally different to try to make it sound like it was a drug deal. This is just the warden getting back at me for my letter. Before all of this I had contacted several attorneys to try to get my son transferred and they would not even give me the time of day because it was going up against a correctional facility. Now I have no money for an attorney and I truly fear for my son's life. I am also disabled and he should be closer to me for visitation purposes. Can someone please help me.

    I'm curious as to how long the state holds evidence for a trial that has already ended. I was tried in 2005 for a crime and I would like to get a copy of the discovery if it still exsists. Who would I contact to get this? Also if its too late to get all that let me know, thanks!

    Where would I look to find the laws in Florida concerning the ownership of chickens in a backyard setting? My city ordinance prohibits them, but I've been told by several people now that Florida law gives everyone the right to 20 hens and that this would supercede (sp?) city ordinance. If someone could just point me in the right direction of where to look, that would be greatly appreciated! Thanks!

    So a few years ago my girlfriend and I had a falling out. She was pissed! She got an injunction against me, and me being a 20 year old kid, did not take it seriously, because after 5 years I wanted to stay friends. I wasn't a crazy stalker I just wrote her parents a letter when they filed the charges.

    Anyway the state took up the case. I plead no contest and got the adjudication withheld. I did 1 1/2 years Community Control and 2 3/4 years probation.

    So of course I didnt contact her during these times.

    But we were really good friends and all this time has passed. There was no reissuing of an injunction during my last court appearance to get the probation removed. The case is done and I believe sealed.

    Do I have the legal right to write her so we may reconcile?

    I went to trial (bench) yesterday on the charge of reckless driving in Florida. I defended myself, accepted no plea deals, and ultimately was found not guilty of reckless driving. I was however found guilty of careless driving, and my judgment said I entered the plea of nolo contendere (no contest) to this charge.

    I was never charged with or accused of careless driving, until judgment, and obviously never defended against it. Is this legal, contestable, or did I just get shafted?

    Are Law Enforcement Officers alloud to record conversations without your knowledge? This would be a phone conversation where the Police Officer called you to ask you questions, and he never said he was recording it. Can someone point me in the right direction?

    does florida law protect ckg accounts that only pension and ss payments go directly in from collection agencies and also if the pension $ is the husband's and the attachment is the wife's can they hold all the money hostage with no access for them ?     I had a credit card debt lawsuit against me dismissed in county court recently "without prejudice" and I would like to know if I can ask the court to dismiss the case "with prejudice" so that they cannot re-file in the future against me for the same issue? I understand that the law firm Mann Bracken, the people who filed against me, recently had to close their doors due to legal shanghais they were involved in concerning debt collection. They contacted me twice at work after I specifically directed them not to contact me on the job. Do I have grounds for dismissal with prejudice? If so, can I just make a request to the court? The only confirmation of dismissal came from Mann Bracken, not the Pinellas County Court from where the summons was issued.

    Can any body be adjudged guilty 2 times, under the same charge for example, violation of probation?

    i read under Florida Statue 948.06, 2(b), unless a probationer was adjudged guilty before for violation, and then i get confused....

    Am in a civil dispute with a customer who refuses to pay more than 1/5 of a bill for rehabilitating her house after a flood. She will not negotiate, offer more than $5/hr equivalent and now has hired a lawyer to represent her despite the fact there is no legal or threat of legal action against her. The lawyers opening salvo included a threat to get a restraining order against me although there has never been a hint of a physical, emotional or threat of any kind under any circumstances. The question is....can a lawyer get a judge to sign a restraining order against a contractor if neither party has hinted at any abuse or threats? thank you very much.

    I am a contracted county employee on a supervisory role. Back in August, I received a "Satisfactory with commendation" evaluation and I signed the evaluation as per the institution's policy. This was in my "evaluation" meeting with my supervisor. Now, it is the end of October and I am asked sign again a new evaluation for the same time period but with "Satisfactory with Reservations", a totally different level and that can mean not renewing my contract. Since I signed the first one, and I am not comfortable signing this new one, what rights to I have? Thanks,

    Long story short: I filed, she answered but didn't send me a copy? Do I file a Default?

    My divorce was final August 2007. 20 days ago I served the EX with a Summons, Supplemental Petition to Modify, and Parenting Plan. She called me a week ago and told me she mailed a copy to the court, and another to me; I didn't receive it. I went to the county clerks website and checked my case, and her Answer is recorded in the events log.

    I have a question my neice will be 18 in August of 2008, she will be graduating in May. She wants to come to another state and live me with and go to college. The problem is her mother is not allowing her to move. My neice is afraid she if she leaves she will be declared a runaway, since school starts before her 18th birthday.     Is it legal for my exhusband to record phone calls we have had without my consent? His girlfriend (who is a police officer) told me tonight that they have been recording my calls for quite some time without my knowledge or consent. I assume they are wanting to use the conversations against me as I am pursuing to modify visitation. Can they do this?
