(2) Federal dollars are not manna from heaven, nor do they represent some form of customer. Federal tax dollars represent our investment. Personally, about 90% of the taxes I pay are federal taxes. Pfeifer believes that if Rhode Island were to take over this business, we could revive it by funneling more of our federal tax burden into its coffers. But how to take over a privately held business?

The structure of Wyatt is that private investors have a guaranteed return on their speculation. They believed that the market in caged humans would continue to spike, meaning (a) laws causing incarceration would remain, or increase (particularly drug and migration laws), (b) sentences would continue to get longer for the same behavior, (c) people would continue to defy these laws, and (d) taxpayers would continue to rubberstamp this growth. The quasi-public element is that the city of Central Falls has the authority to choose the subcontractors who operate the facility, including lobbyists and PR firms. The latter remains beholden to the bondholders, and this is the element Pfeifer believes should be taken over by the state. Im not sure the legality of a state agency existing to enrich private bondholders, but it surely smells like the fishing fleet in Pt. Judith.

Who are the bondholders? Any proposed bailout of Wyatt should come with a listing of the profiteers. The innocuous investment structures, like Atlantic Capital Management or Liberty Fund etc. should come with those owners, and so on. Considering this business is on the brink of bankruptcy, the taxpayers need to know who is making the millions. Could it be Chaffee? Kilmartin? Buff Chace? Judge Pfeifer himself?? Nobody knows. Or do they?

One former investment banker, Catherine Austin Fitts, who happened to be a partner at Dillon Read when they floated the Wyatt bonds knows a few things. One lid she blew open is the connection between Brown University and Wyatt. Browns top endowment investor, John Birkelund, happened to be chairman of Dillon Read (which subsequently merged with UBS). When the stock split happened (the big payday for initial investors who can pump up a stock), Brown came away as the single largest bondholder. With so many of the original investors being Dillon Read partners, he used Browns endowment to enrich himself. And now Pfeiffer suggests using the states largesse to enrich whoever is holding the bonds.

Wyatt hasnt earned a buck (beyond the bond interest payments) in over two years. Although it has been in operation for almost two decades, the Corporation is on the hook for $238 million more dollars to pay off the prison. This requires an analogy:

Your uncle Vin has been paying on his house for 18 years. Hes been selling carpet cleaning products out of the basement, and hasnt made a dime in two years. And he says, Ay, cmon. If you take over the payments, you get to own the thing in 2034! He gives you a big shiny smile. But then you say, Wait a minute. You been making payments for a while, and you still got $238 million more but I can build a new house today for $100 million!

Halliburton, the builders of Wyatt, build prisons all the time using their subsidiary Brown & Root. It is helpful in getting government contracts to know some people in power (a little tip for you) and fund them. Their Gitmo prison only cost $30 million. An Alaskan prison far larger than Wyatt is going up for $240 million. Apparently Sarah Palin doesnt understand what a Lease Revenue Bond is either. Go figure. It doesnt hurt that the construction firm gave $25k in political donations between 2005 and 2008. Wyatt wouldnt have been built with out their own local insider team, including Mike Doyle, a founder of RDW Group, a powerful lobbying and PR firm by the RI Statehouse.

What is Pfeiffer thinking? His entire strategy hinges on a pyramid of inferences:

1. A.T. Wall and the RI Brotherhood of Corrections can restore the integrity of Wyatt, following the death of Jason Ng under their custody;

2. ICE (Immigration Customs Enforcement) will resume the use of Wyatt, rather than the other struggling prison businesses in New England who snatched up the federal tax dollars;

3. The IGAs (Inter-Governmental Agreement) will remain in the range of $90-$100 per prisoner per day (each agency can negotiate its own rates);

4. The possible extra prisoner revenue, combined with a few slashed contracts in the Wyatt administration, will cover the bondholders profits and the increased labor wages and leave some money for the Rhode Island General Fund to turn a profit.

FAIL. The Wyatt employees earn considerably less than ACI employees. Wyatt would have to adhere to RIBCO, as their contract wont allow the state to operate a separate facility. With overtime, some RIBCO employees are earning six-figures while many are over $60k. Although a few suits would take a $10-50k pay cut, a few hundred guards would practically double their salaries. And only a state administrator can truly imagine all the other subtle fees and regulation expenses to turn a private business into a state agency.

Privatization alleges to be cheaper than public ownership because it dodges many regulations, particularly around labor security. It generally ends up NOT cheaper (lets leave the better debate aside), as has been documented about private prisons, because of profits to investors. In the case of Wyatt, Judge Pfeiffer is proposing an agency that has the burdens of regulation AND the burdens of investor profiteering. From a business perspective, this is the worst combination conceivable. Unless, of course, you are intertwined with the investors who will gain even further guarantees. With so many hints of corruption around the Wyatt, they were wise to hire the Attorney Generals sister, but the hounds are closing in. The Wyatt deal smells more like the Johnston Landfill.

At a time when the federal government is moving towards an overhaul of the criminal justice system and states have been moving to decriminalize marijuana, one should look curiously at any investment based on further increase of prisoners. We have peaked. With so many billions committed and so much cell capacity, American residents and taxpayers are questioning their priorities, particularly as the creation of a prisoner requires serious havoc being wreaked upon communities. Militarizing schools and neighborhoods into ghettos is a controversial answer to the call of Economic Development.

Rhode Islanders should be telling their elected officials Just Say No to Wall Streets Prison Profit. A bill should enter the legislature calling for a Fiscal Impact Statement. A bill should be submitted to repeal the Wyatts tax exempt status, as they have reneged on their commitment (the only selling point 20 years ago) to provide economic aid to CF. Pfeiffers proposal suggests he is either ignorant of the realities or holds dubious motives- and he needs to avail himself of those critiques.

The city of Central Falls is not holding the bag. The speculators are.

Complaint against Wyatt CEO Fair to get hearing from R.I. Labor Relations Board

The state Labor Relations Board has issued a complaint against the CEO of the cash strapped Wyatt Detention Facility Michael V. Fair for creating an atmosphere of fear and intimidation at the quasi-private Detention Facility during the tumult in Central Falls last year. The board is holding a hearing at 9 a.m. Tuesday at its Cranston headquarters.

According to the complaint, Fair violated state labor laws when he took over the facility and threatened employees with termination if they did not cooperate with his hand picked leadership team.


Fair's actions interfered with, restrained and coerced members in exercising their rights, the complaint states. And his failure to clarify his directives to his employees after being asked to do so created an atmosphere of fear and intimidation.

The complaint follows a charge filed by members of the F.O.P. Lodge which represents Guards and employees of the prison.

The union local asked Fair to clarify his intentions so that the professional staff at the facility could continue to do their jobs free from fear of reprisal,a union spokesperson said. When Fair failed to provide such clarification,the union filed an unfair labor practice charge.

After an investigation, the Labor Relations Board issued its complaint in February.


The complaint delineates for Fair what he can and cannot do in terms of the rights of our members, their rights of free speech and freedom of assembly and their rights as unionized employees, a union spokesperson said.

Both sides will be asked to testify under oath in the near future.

After the hearing, the state Labor Relations Board will determine if the complaint should be upheld or dismissed at the next board meeting.

Egypt, Libya, Iran,and Central Falls; What do they have in common? They are small, angry and divided populations who are tired of being governed by embattled madmen. The leaders of these entities govern by striking fear into the hearts of the people. Intimidation and threats are a way of life. Its called manangement by demoralization.These defiant leaders vow to strike back at the angry protesters. They stand at their podiums ( or behind their desks) and pound their fists vowing never to succumb to the mayhem . The tension escalates and the "people" muster the courage to force these dictators from office. As the dictators weaken, more and more people will rise up in protest. The tales of intimidation and terror brought on by these tyrants will soon be uncovered by the winds that once brought them to power. Watch them closely now; they may appear to be steadfast in their commitment to remain in power, but they are planning their departures. Quietly and without fanfare, probably over a weekend or in the middle of the night they will be wisked away by the few remaining loyalist who will be left alone, abandoned, leaderless, terrified, as once were the people of these misguided regimes. They once possessed the world and its gold, but gold wont bring them happiness as they grow old. Strength to you,brothers and sisters.

What a shame full place to work. Where do I begin with the mess that is the Wyatt detention facility? There are so many injustices done to the employees of the Wyatt detention facility I dont know where to start. I intend to examine and dissect the clearly evident problems of the Wyatt detention facility.
Lets start from the top down approach, the Wyatt board of directors. The board of directors is typically responsible for the following responsibilities: governing the organization by establishing broad policies and objectives; selecting, appointing, supporting and reviewing the performance of the chief executive officer, ensuring the availability of adequate financial resources, approving annual budgets, accounting to the bondholders for the organizations performance and setting their own salaries and compensation. So it would be obvious to say that these individuals should have a lengthy history of entrepreneurship or careers in successful corporate entities. Well not only do these three board members not meet these prerequisites I cant even give them credit for running a hot dog stand or selling candy bars for the boy scouts. Number one, Mr. Bruce M. Corrigan, previously a fire fighter and also a ? Yes I guess thats about it. We all have great respect for firefighters but no experience in business. Number two, Mr. Michael Golenia. And number three Dr. Antonio Barajas an emergency room physician at Roger Williams Medical Center in Providence. Barajas also serves as president of the Rhode Island Mexican-American Association. Yep a whole boat load of corporate guru wrapped in that one. Lets also mention the out standing mandate that the board members must be picked from central falls only; a one mile sea of financially talented individuals and not a rotting ghetto filled with social leeches and gang members. No not Central Falls, what gave away this gleaming metropolis of corrupt politicians? Not the street after street of boarded foreclosed houses filled with crack heads and gangsters. Gee what an absolutely marvelous mandate that one is, lets hinder Wyatts ability to reach out across the state and find truly gifted financial minds to govern Wyatts board. Nop instead well limit our bullpen to robbed and mismanaged cities completely destroyed and filled with less savory individuals. I mean a position on a board of directors for a multi million dollar corporation isnt important or anything not for the success of that entity. Lets not forget who gets to appoint these people to the board mayor Charles D. Moreau. Wow where do I start with this scumbag. Moreau and his administration are under investigation for a program where the mayors childhood friend was awarded an emergency, no-bid contract to board up more than 200 vacant houses in the city for more than $2 million. The state police has been investigating the program, among other things namely that boiler incident where Charlie scumbag charged the replacement of his home boiler to the taxpayer. Now we start to see why this facility is such a mess. Was any one wondering why that completely ridiculous stipulation was attached to our peace officer status? The work purposes only supplement limiting us to a bull crap status. How can this blatant slap in out faces be tolerated any more. We were given peace officer status to stop us from organizing and striking due to the disgraceful treatment of us and at the same time a work purpose only supplement attached to just Wyatt officers so admin could sleep better at night knowing we couldnt carry fire arms and possibly embarrass the facility in a off work incident! I mean its not like we do anything dangerous like house federally dangerous detained individuals that we run into constantly on the streets. This is the absolute disrespect this facility regards us as. What happens if one of us our children gets hurt or killed because of a disgruntled former detainee? Do you think Fair or his cohorts will care? Probably not, Mr. Fair will still be double fisting cigarettes on his park bench like a real professional. Hey Mr. Fair why dont you just ash your cigarette on my face. I mean thats what youre doing to all of us when you sit on the bench in front of the public like a tacky carvone. Who the hell double fists two cigarettes I guess thats what 250,000 a year buys you these days.
But the question is why was this peace officer supplement ratified so easy? Maybe because Wyatts legal counsel is Peg Lynch-Gadoleta the sister of attorney general Patrick Lynch. And for those of you who dont know the attorney general has the last say in peace officer status and right to carry issues. But friends it gets even better mayor Moreau even hired Patrick Lynchs girlfriend Cynthia Stern for a two hundred an hour spokesman job at Wyatt. But due to investigations into this good ole boys crap Miss Stern currently doesnt work for Wyatt anymore. And yet it gets even better. In 2004, after two years working for Lynch at the A.G.s office, Stern went to work at RDW Group, a public relations firm. RDWs CEO is Mike Doyle, who was one of the founding conspirators to earn profit from a prison in Central Falls. RDW employees have donated over $10k to Lynch since 2004. After revelations that an investigation is underway regarding Moreau paying $2 million of taxpayer dollars to his friend (for about $100,000 worth of boarding up houses)... Cynthia Stern quit working for Mayor Moreau. Because the mayor is the de facto chair of the Wyatt, she also quit working for the Wyatt. Stern went back to work for RDW Group.
Gee no conflict of interest there, what a caldron of gangster snakes.

What You Didn't Know About the For-Profit Wyatt Prison in CF...

My last post on the Wyatt (responding to a potential state takeover) generated a number of inquiries about this privately-owned prison in Central Falls, RI. I realize it is time for another installment of information.



What is Wyatt?

From their own website:

The Donald W. Wyatt Detention Facility, located in Central Falls, RI, is operated by the Central Falls Detention Facility Corporation, which was created by the Rhode Island General Assembly in June 1991 to design, build, and manage the first publicly owned and privately operated detention facility in the Northeast. It is a quasi-public detention facility designed to function as an economic engine for the city of Central Falls and the state of Rhode Island.

The Wyatt is NOT publicly owned, although the mayor appoints the corporate board. It is owned by private bondholders whose repayment, by corporate decree, come before anything else (including operating costs). Anyone who believes the Board of Directors owns a company might want to run that by the investors with stock/bond certificates. It is, however, publicly funded. All of their revenue comes from tax dollars paying to hold prisoners.



Wyatt is going bankrupt.

This prison, like many privately-owned prisons, was a financial scheme worthy of a credit default swap or any other esoteric Wall Street chicanery. It has been losing $5 - $10 million per year since the expansion and refinancing. The building itself is worth under $90 million and depreciating, while the corporation owes $141 million of interest on $101 million in debt. Thats right, they are paying 140% interest on the loan. If someone bought a car listed at $10,000, but took out a loan that came out $24,000, they would be considered an idiot, but thats the difference when one is playing with someone elses money.



And keep in mind: it is the taxpayers who are paying the interest. Not a bad loan to own, ay?



According to Receiver Judge Pfeiffers report (p.56), the prison has lost money every year since the expansion and is in technical default on its bonds. Two years ago when the mayor proposed selling Wyatt to private prison mega-corporation CCA, the land and prison were independently assessed at $45 million.



Why the Expansion in 2005?

The expansion and refinancing of the original bonds was an opportunity to make millions for some individuals, while delaying the collapse. Original bondholders now had the money to cash in as the corporation took out a fresh batch of new money. The expansion allowed middlemen and construction people to cash in, with everyone getting a small bite from over $100 million. A project coordinator can easily explain 10% of costs going their way, and Anthony Ventetuolo explained that his 2% off the top is totally normal.

The refinancing also created a rainy day fund, to make bond debt payments when the income is not flowing; it is a way of concealing the income not flowing. This fund is done.



Consider that the 1992 bonds were a total of $30 million. The 2005 bonds were $106 million, including fees, and yet the prison did not even double in size.



Who Manages the Money?

Cornell (Cox) Corrections were dismissed when the new cash flow came in with the expansion/refinancing, and Anthony Ventetuolo took over under the name of AVCORR. Ventetuolo was a founding partner in the deal to win a bid and build a prison for the Bureau of Prisons to use in Southeastern New England. He was a highly paid consultant by the Corporation, and made over $1 million just during the expansion. AVCORR took over the prison when the new money flowed.



Whats in it for Central Falls?

The original reason Rhode Island authorized these capitalists to make an investment in public human suffering is because it was believed to be a revenue stream for the local municipality. Sounded good at the time to the Legislature. This revenue is theoretically coming from discretionary City Impact Fees. The fees have not been paid in several years, and the bondholders threatened to file suit against the Corporation if they pay the City prior to paying their bonds principal and interest.



Is a City Impact Fee the same as revenue?

It is called a Fee, which is something you pay for a service. In this case, it is absolutely discretionary. What service does Wyatt get? I call on my public management gurus to help answer that, but there are services like water and sewage that add up to real costs. The Corporation is tax exempt, as well. And if the City Impact were merely $1000 per day (A conservative estimate for a place holding over 1,000 people. prisoners and employees), that adds up to over $6.5 million since the Wyatt was built in 1992. The Corporation has paid Central Falls $2 million over the past 8 years (I am unsure how much, if any, was paid prior). Would you call that revenue?



Has Anyone Investigated This Corporation?

Yes. The bondholders themselves realize they are caught holding the bag and somebody is dipping in, which only makes it worse. In 2008 they called for an independent audit, and hired Michael Fair. The auditor released a report in 2009, and found serious financial control deficiencies. Considering Arthur Anderson was the original auditor of Wyatt under the Cornell Corrections regime, one can only guess how it used to be.



Naturally, every corporation tries to avoid a scandal and would prefer to deal with things privately. This one has close ties to Attorney General Patrick Lynch (2002-2010), who never threw the book at anyone involved with the Corporation, and hired his sister as their legal counsel. The bondholders threw Ventetuolo out in 2009 (I am not aware of any pending charges) and hired Michael Fair to run the operation on an interim basis. It is worth noting that Patrick Lynch recused himself regarding the investigation of Mayor Moreau in other matters. Considering the power Moreau wielded in appointing the Board of Wyatt over the years, Lynch basically recused himself from the Wyatt.



How is the Corporation Connected to Central Falls Bankruptcy?

The Central Falls smokestack blew, just prior to the 2010 elections. Im not sure entirely how the prison and the city are intertwined, except that the mayor has power to appoint all of The Corporations local board members. This mayor, Charles Moreau, is the same man who was using the city tax dollars to pay his friends $10k to board up foreclosed properties. If that is any indication, there are any number of rocks to look under to follow the money.



In a small state like Rhode Island, it is understandable for a mayor, police chief, judge, and state attorney general to be chummy. It doesnt mean that corruption is evident; it only calls into question the capacity of anyone to have independent oversight and investigation. It is not surprising that the Receiver of Central Falls, Judge Pfeiffer, tossed the mayor aside and is now talking about Wyatt. It is suspicious that he sees the state bailout of Wyatt to be a good thing in any way except to bailout the bondholders.



The bottom line is that the Wyatt Corporation is going under, and not just because we have more prison cells than prisoners in America, due to a glut of investment. It is because one should anticipate graft and mismanagement from any endeavor that lacks a Buyer/Seller balance of power, one that involves taxpayer funds, and is an industry that feasts on social degradation. Cornell Corrections has since been swallowed up by another prison profiteer, Geo Group, as the entire industry is under strain. Mergers often indicate an excess of capital, which is clearly the case for those who banked on a prison planet. It is a sad industry that pays millions of dollars to lobbyists, to both D.C. and the state capitols... to push for more product: People in Prison.

25-3-3 Work on Sundays or holidays. (a) Work performed by employees on Sundays and holidays must be paid for at least one and one-half (1 1/2) times the normal rate of pay for the work performed; provided: (1) that it is not grounds for discharge or other penalty upon any employee for refusing to work upon any Sunday or holiday enumerated in this chapter; (2) any manufacturer which operates for seven (7) continuous days per week is exempt from the requirement of subdivision (1).

(b) Any manufacturer of wall-covering products which operates for seven (7) continuous days per week, twenty-four (24) hours per day, and has complied with the provisions of subsection (a) is exempt from the requirement that the work be voluntary on Sundays as provided in subsection (a); provided, that the manufacturer increases employment by at least ten percent (10%), within one year of its conversion to continuous operation from non-continuous operation.

(c) Any manufacturer that operates three (3) shifts, or begins its work week on Sundays, may begin the shift or start the work week at 11:00 P.M. on Sunday and not be required to pay its employees one and one-half (1 1/2) times the normal rate of pay during the one hour period between 11:00 P.M. Sunday and 12 midnight.

(d) Any and all employees of a chauffeur driven limousine or taxi cab company that operates seven (7) continuous days per week, twenty-four (24) hours per day are exempt from the provisions of subsection (a) hereof.

(e) Any car rental company which operates a car rental agency at T.F. Green Airport and is required pursuant to its lease agreement with the Rhode Island Airport Corporation to operate on Sundays and/or holidays is exempt from the provisions of subsection (a) hereof with respect to work performed at its T.F. Green Airport location.

Correctional Officers entitled to a minimum of $22.76/hr?

The US Government might think so!

The Service Contract Act demands that companies providing services to the government must pay their employees the prevailing wages, and sets out the prevailing wages for certain Job Classifications. Correctional Officers, in this area, should earn at least $22.76/hour.

This law is administered by the US Department of Labor (Providence office DOL, Wage and Hour: (401) 528-4431).

Here's an odd little twist:
The only way a company can pay LESS is when there is a collective bargaining agreement in place setting wages LOWER than the prevailing rate.

Go figure.

Check with your union about how the Service Contract Act might help.

Can it be applied retroactively?
Check with your union or the Dept. of Labor.

Special note:
For the income that's generated at the Wyatt, there's a pecking order as to how it's spend in their bondholder's agreement.
Bond holders get paid first, Salaries and wages MUST be paid before any gift to the city in lieu of taxes. CF should never be considered for payment before those who actually work at the Wyatt!

ALL OCCUPATIONS LISTED ABOVE RECEIVE THE FOLLOWING BENEFITS:

HEALTH & WELFARE: Life, accident, and health insurance plans, sick leave, pension plans, civic and personal leave, severance pay, and savings and thrift plans.
Minimum employer contributions costing an average of $3.35 per hour computed on the basis of all hours worked by service employees employed on the contract.

VACATION: 2 weeks paid vacation after 1 year of service with a contractor or
successor; 3 weeks after 10 years, and 4 after 15 years. Length of service includes the whole span of continuous service with the present contractor or successor,wherever employed, and with the predecessor contractors in the performance of similar work at the same Federal facility. (Reg. 29 CFR 4.173)

HOLIDAYS: A minimum of eleven paid holidays per year: New Year's Day, Martin Luther King Jr's Birthday, Washington's Birthday, Good Friday, Memorial Day,Independence Day, Labor Day, Columbus Day, Veterans' Day, Thanksgiving Day, and Christmas Day. A contractor may substitute for any of the named holidays another day off with pay in accordance with a plan communicated to the employees involved.) (See 29 CFR 4.174)

** UNIFORM ALLOWANCE **

If employees are required to wear uniforms in the performance of this contract
(either by the terms of the Government contract, by the employer, by the state or local law, etc.), the cost of furnishing such uniforms and maintaining (by laundering or dry cleaning) such uniforms is an expense that may not be borne by an employee where such cost reduces the hourly rate below that required by the wage determination. The Department of Labor will accept payment in accordance with the following standards as compliance:

The contractor or subcontractor is required to furnish all employees with an
adequate number of uniforms without cost or to reimburse employees for the actual cost of the uniforms. In addition, where uniform cleaning and maintenance is made the responsibility of the employee, all contractors and subcontractors subject to this wage determination shall (in the absence of a bona fide collective bargaining agreement providing for a different amount, or the furnishing of contrary affirmative proof as to the actual cost), reimburse all employees for such cleaning and maintenance at a rate of $3.35 per week (or $.67 cents per day). However, in those instances where the uniforms furnished are made of "wash and wear" materials, may be routinely washed and dried with other personal garments, and do not require any special treatment such as dry cleaning, daily washing, or commercial
laundering in order to meet the cleanliness or appearance standards set by the terms of the Government contract, by the contractor, by law, or by the nature of the work, there is no requirement that employees be reimbursed for uniform maintenance costs.

I you really take a close look at Michael V Fair's executive Summary it isn't so much a negative reflection on the Warden, Wyatt Management, or the staff who work hard every day. I really shows a huge lack of QUALIFIED leadership from the board of the CFDC. In the Mayor's infinite wisdom, he has stacked the board with his "Yes Men". Through their collective incompetence and lack of knowledge about running a multi-million dollar entity, they have sat on their hands and tanked a good thing for the City of Central Falls. What the Mayor needs to do is seek professional, experienced and knowledgeable people for the board, who will be dedicated to making the facility into a stable long term asset for the City of Central Falls. Right now is not the time for politics. Right now we have the opportunity to create something sustainable that will financially benefit the future of the City. The staff of the facility, especially the Warden, have worked long and hard to get this facility to where it can be all that for the City. Work with them, Mr. Mayor, and not against them and you won't be disappointed with the result. Make this the success story it has all the potential to be.

WORKING CONDITIONS: Correction Officers may work in a correctional facility, alone in an isolated area; may work varied shifts, weekends, holidays, or nights and are subject to a standby (on call) work status; may be subjected to verbal and physical abuse from others; may be required to interact with people who are under physical and/or emotional stress; stand and walk for prolonged periods of time; are subject to injury from firearms; may work under exposure to adverse weather conditions; may travel for job-related purposes; and may be required to furnish private transportation for reimbursable job-related travel.
SALARY: Inquiry concerning salary should be directed to the appointing authority at the time of the employment interview.
ENTRANCE REQUIREMENTS:
1. AGE: This examination is open to persons who have reached the age of nineteen as of the date of the examination (Massachusetts General Laws, Chapter 125, Section 4). Applicants must provide proof of birth date to satisfy this requirement prior to consideration for appointment.
2. Fire Arms Permit and Special State Police Commission Certification as a Correction Officer requires that the applicant be able to satisfy and maintain the eligibility requirements for obtaining a license to carry a firearm. Pursuant to Massachusetts General Laws, Chapter 140, you must be a United States citizen in order to obtain a Fire Arms Permit. (Aliens cannot possess a firearm.)
Medical As a condition of employment, an applicant for Correction Officer will be required to pass a psychological and medical examination that includes drug screening.
Training Candidates must be able to complete satisfactorily the Department of Correction's training program for Correction Officers during their nine-month probationary period (Massachusetts General Laws, Chapter 125, Section 9, as amended by Chapter 468, Acts of 1979).
Smoking Chapter 27, Section 2. As the result of legislation (Chapter 697, Acts of 1987), persons appointed to Correction Officer positions as a result of this examination will be prohibited from smoking tobacco products after their appointment. Violators are subject to termination of employment.
Prior Convictions/Incarcerations No person who has been convicted of a felony or who has been convicted of a misdemeanor and has been confined in any jail or house of correction for said conviction shall be appointed to the position of Correction Officer. (Massachusetts General Laws, Chapter 125, Section 9).
Physical Abilities Test In accordance with Chapter 32, Section 5(3(e)), of the Massachusetts General Laws, applicants will be required to pass a physical abilities test as part of the selection process. A current and valid Massachusetts Class D Motor Vehicle Operators license or the equivalent from another state is required.

EXAMINATION CONTENT: The written examination will be designed to test, where practicable, the following abilities which have been established as qualifications for the position: ability to gather information through examining records and documents and through observing and questioning individuals; ability to read, understand, explain and apply the laws, rules, regulations, policies, procedures, specifications, standards, guidelines, and instructions/post orders governing assigned unit activities; ability to write concisely and accurately to extract facts, express thoughts clearly, and develop ideas in logical order for incident, disciplinary, climate, and other general report writing; ability to work accurately with names, numbers, codes and/or symbols, in order to communicate via two-way radios and issue keys and equipment via chit system; ability to analyze and determine the applicability of quantitative and qualitative data such as demographic breakdowns, meal counts, and activity counts, in order to draw conclusions, identify trends or problems, and make appropriate recommendations; ability to maintain accurate records in Inmate Management System (IMS), record books, and logs to track inmates, supplies, and movement of equipment, vehicles, and inmates to ensure accountability and security. CREDIT FOR EMPLOYMENT/EXPERIENCE AS A CORRECTION OFFICER I: Pursuant to the provisions of Section 22 of Chapter 31, individuals may apply for credit for employment or experience in the position title of Correction Officer I. Information on how to apply for this credit will be mailed with your notice to appear for the examination. On the day of the examination, you will be asked to provide the details of any such employment or experience you have as a Correction Officer I as the result of service on a state-run correction officer force, including location, dates of service, and number of hours worked per week, and to submit documentation supporting these claims. HOW TO APPLY
You may apply for this examination, using a credit card, on-line at the Human Resources Division website: https://www.csexam.hrd.state.ma.us/hrd until midnight on February 17, 2009. A confirmation number for each transaction will be issued.
You may also obtain a paper application form, and file it along with the examination-processing fee (or fee waiver form) in person or by mail with HRD. Applications and fee waiver forms may also be available at city and town clerks offices across the state. Your Request for Fee Waiver must be submitted with a paper application. If you file an on-line application you are unable to request a fee waiver. If you mail your application, send all correspondence by certified mail with "return receipt requested," if possible. Your application MUST be received in HRD by 5:00 p.m. on February 17, 2009 or be postmarked by midnight on February 17, 2009.
CURRENT MILITARY PERSONNEL: All military personnel who, in connection with current service, CANNOT be in Massachusetts on March 21, 2009 should contact the Human Resources Division to request a make up examination. To request a make up, you must:
file an application and processing fee by the last filing date (February 17, 2009);
request such accommodation in writing, with a copy of your military orders attached; include in your letter either your daytime base phone number or name and phone number of a Massachusetts resident with whom you are in regular contact.
TESTING ACCOMMODATIONS FOR PEOPLE WITH DISABILITIES: If you need special testing accommodations due to a documented impairment such as a hearing, learning, physical, mental or visual disability, fill in the circle in item #15 of the paper application or click the corresponding circle in the on-line application, and include with your paper application a letter detailing what type of accommodation you require at the exam site. If you will apply on-line, please forward the letter to HRD. You must also include a letter of support from a qualified professional. Without such a letter, we cannot guarantee that we will be able to grant your accommodation. This information is sought only to provide reasonable accommodation on the day of the examination and will not be used for any other purpose.
EXAMINATION FEE: All paper applications must be accompanied by a money order, bank check, or by a completed fee waiver form. The examination-processing fee is $100. Payment by money order or bank check should be made payable to the Commonwealth of Massachusetts. Please print your name, address, social security number, and the examination announcement number 8221 on the front of the money order or bank check. Payments by Master Card and VISA are also accepted when applying via the web site or in person. NO CASH OR PERSONAL CHECKS. There will be NO REFUNDS of the examination-processing fee unless the examination is cancelled by HRD.
FEE WAIVER: The examination-processing fee may be waived for applicants receiving certain forms of state or federal public assistance, unemployment insurance, or workers' compensation. If you are claiming a fee waiver, fill in item #16 on your application. Fee waiver forms are available from, and must be filed with, the Massachusetts Human Resources Division (see address below). Waiver forms must be accompanied by proof of eligibility, for the subject time period, in the form of signed and dated receipts, check stubs and/or other documentation from the agency providing the assistance.
VETERANS PREFERENCE

Definition of a Massachusetts Veteran M.G.L. Chapter 4, Section 7, Clause 43 as amended by the Acts of 2004 Effective August 30, 2004: To be a veteran under Massachusetts law, a person is required to have either 180 days of regular active duty service and a last discharge or release under honorable conditions OR 90 days of active duty service, one (1) day of which is during wartime and a last discharge or release under honorable conditions. A chart defining wartime service is available on-line.

VETERANS PREFERENCE: If you are claiming veterans' preference and if your eligibility for veterans preference has not been approved before by HRD, you must submit a copy of your DD Form 214 (Release From Active Duty) in order to receive proper credit. Your notice to appear for the examination will indicate whether or not you are already classified as a veteran. Qualifying service must have been in the Army, Navy, Marine Corps, Coast Guard, or Air Force of the United States. Please note that active duty exclusively for training in the National Guard or Reserves does NOT qualify you for veterans' preference. National Guard Members or Reservists must have 180 days and have been activated under Title 10 of the U.S. Code - OR- if activated under Title 10 or Title 32 of the U.S. Code or Massachusetts General Laws, chapter 33, sections 38, 40, and 41, must have 90 days, at least one of which was during wartime. The Members last discharge or release must be under honorable conditions.

Those who otherwise qualify for veterans' preference, but are still in military service may, as of July 1, 1998, claim such credit by supplying proof, on official letterhead with appropriate signature, of their military service to date, including the dates of active duty, current assignment, and estimated time of separation. The individual must provide official documentation of honorable discharge at the time of appointment. [See MGL, Chapter 31, Section 3, Clause (f)].

Minimum Service Exception: It is not necessary for an applicant to complete the minimum service for wartime or peacetime campaign if he/she served some time in the campaign and was awarded the Purple Heart, or suffered a service-connected disability.

Disabled Veteran Status: Claims for status as a disabled veteran require written confirmation from the US Veterans Administration of a continuing service-connected disability rated 10% or higher. Applicants wishing to claim status as disabled veterans will get the opportunity to claim such at the test site with instructions to follow.

On Tuesday, February 24, 2008 at approximately 8:00 am, this facility was subjected to an Un-Announced audit by a team of seasoned correctional professionals, some whom had retired from the Bureau of Prisons, State Correctional Facilities, the Office of the Federal Detention Trustee and the United States Marshal Service.



As a result of their review each auditor presented closing comments relative to the area they were responsible for, which included every area, policy, procedure and operation of our facility. I assure you they diligently and vigorously reviewed all facets of our day to day operation and subsequently came to the conclusion that they were tremendously impressed by you the staff who are called upon each and every day to ensure we successfully accomplished our goals and fore fill the mission of this organization.



And for that, I along with Warden Salisbury sincerely thank you.
