BILL ADVANCES TO PUNISH ‘DEHUMANIZING’ ASSAULT OF PRISON GUARDS

STATE HOUSE, BOSTON, FEB. 1, 2010…..A proposal aimed at tacking on stiff penalties for inmates who fling feces, urine or other bodily fluids at prison guards is on the move in the House, where it has died in each of the last two legislative sessions.
The bill (S 997) would punish inmates who assault corrections officers, prison employees, volunteers or contractors using feces, urine, mucous, semen, blood or saliva with a 2.5-year sentence in a house of corrections or a five- to 15-year sentence in state prison. The punishment would be added to the end of any ongoing sentence, according to the proposal.
The House gave initial approval to the bill Thursday. The Senate passed the bill Jan. 13.
“The [assault and battery] bill is an important issue,” said Seth Gitell, a spokesman of House Speaker Robert DeLeo. “It’s one [the speaker] expects the House to take up soon.”
The Patrick administration supports the proposal, although aides say they’d prefer it without the option for a five- to 15-year state prison term. Christopher Fallon, a former corrections officer of 20 years, told the News Service the proposal is necessary to punish a “dehumanizing type of assault.”
“It’s hard to explain to anybody what it really does to the officer’s psyche,” said Fallon, now the Department of Corrections director of outreach. “You really just want to lash out, but many times, you can’t lash out. That’s one of the constraints we have put upon us. It really takes a long time to get over the fact that you’ve just been really violated.”
Fallon said officers often fear they will contract a communicable disease, and sometimes take “cocktails” meant to prevent infection, which often force them to miss work. Fallon said he’d witnessed officers hit in the face with urine and feces, which he described as “vile.”
The legislation advanced in previous years with the support of public safety advocates, including the co-chairs of the Committee on Public Safety, the Patrick administration and corrections officers, but ran into objections from the AIDS Action Committee, which said the bill stokes an unfair stigma about communicable disease. Advocates for prisoners with mental disabilities also charged that the bill would unfairly target those inmates.
Leslie Walker, executive director of Massachusetts Correctional Legal Services, said individuals who are committing the proposed crime are probably mentally ill.
“I would bet a large sum of money it was mentally ill prisoners in segregation who are beyond enduring the confines of their 24-hour-a-day lockup,” said Walker. “This is, in my mind, another way to criminalize mental illness.”
Walker called the bill “completely and totally unnecessary” and said individuals can be prosecuted under the existing assault and battery law on the books.
“I have never heard of it happening from someone who is not an open mental health case,” she said, adding that her preferred solution would be to remove prisoners from segregation units, which she said can sometimes foster mental illness.
However, backers of the bill say it will help root out criminals who intend to inflict pain, and potentially disease, on prison guards, and they describe the trauma corrections officers suffer when they face such assault – most undergo a battery of blood tests to ensure they haven’t contracted any illness.
“In my discussions with members of the corrections officers union, it’s just violent criminals, mean-spirited criminals and it’s never been conveyed to me that the ones who do this tend to be the ones who are very imbalanced,” said Rep. Robert Koczera (D-New Bedford), a co-sponsor of the bill in the House.
Koczera said he is hopeful the House will pass the bill this session.

What this Union truly needs is to rethink it's structure.
First of all the Executive Board should be more of a steering commitee.
We need to hire professional people to run the day to day and represent us on negotiations.
1) An Executive Director: Hired by the E-Board and pay is based on performance.
2) A Legislative Rep: Again hired by E-Board and pay is based on performance. ALot of Ex Senators out there who know the ins and outs and have the connections we need.
3) A Business Agent: Hired by E-Board and paid on performance.
The members of the E-Board would only work 2 days a week in the union office the rest of the time they would be back in the institutions. Have all members in one day a week at union office to meet together and then one other day so that we have an Officer there at all times overseeing the process.
This would allow us to put forth a professional appearance and the hired professionals would be able to speak more frankly about situations as they would not have to worry about petty retaliations by the DOC when their term was up, and the harder they worked for us the better their pay.

I've come to the conclusion that being with my family is going to be alot more important than watching a bunch of coddled inmates, so I will refrain from showing up for work Dec 24th or Dec 25th so that I might be able to celebrate with the people most important to me.

AUCLAIR FUNERAL HOME William P. “Bill” Thran, 50, of Joseph Drive, Fall River, husband of Jacqueline (Melanson) Thran, died Wednesday, December 16, 2009.
A graduate of Bishop Connolly High School and University of Massachusetts-Dartmouth, he was employed by Alpert Brothers and for 25 years by the Massachusetts Department of Corrections at Bridgewater. He was an avid sports fan.
Besides his wife of 27 years, he leaves 2 sons, William C. Thran of Fall River and Timothy M. Thran of South Boston; 4 siblings, Norman Thran (wife late Janice) of Ohio, Mary Connell (husband James) of Tiverton, Kathleen Northrop (husband Steve) of Swansea and Ellen Shaw (husband Kenneth) of Carver; his mother-in-law, Mrs. Normand (Claire) Melanson of Fall River; sisters-in-law, Mrs. Jeffrey (Therese) Cabral of Fall River and Mrs. Thomas (Jeannine) Joseph of Little Compton; many nieces and nephews and several very close friends. TAMPA - The detention deputy was sitting at his desk when the inmate attacked. The deputy is 64; the inmate 40 years his junior.
Deputy Kenneth Moon had another disadvantage: He was the sole deputy in a jail pod that houses 62 inmates. The only nearby people who could help him were there because they have been charged with attempted murder, home invasion, drug dealing.
And yet they did.
The first one, Jerry Dieguez Jr., is in jail on an armed home invasion charge. When he saw inmate Douglas Burden put Moon in a chokehold, Dieguez didn't hesitate.
He ran behind the desk and landed a haymaker of a punch on Burden.
Inmates Hoang Vu and Terrell Carswell also provided backup. Vu is charged with attempted murder; Carswell with robbery, marijuana possession, cocaine trafficking and failure to register as a sex offender. He also has a charge of obstructing an officer.
While Dieguez, Vu and Carswell kept Burden off the deputy, another inmate came charging over.
David Schofield, who's in jail on aggravated assault and battery charges, reached over to the deputy, took his radio and called for help.
The inmates are credited with saving their jailer's life.
"Their past acts aside, you know, you've got to applaud them for what they did," said sheriff's Col. Jim Previtera.
Previtera said Burden had Moon in a classic chokehold, one used in martial arts.
"It cuts off the blood supply," he said, "and if it's applied properly can actually crush the windpipe or the trachea."
Deputies eventually restrained Burden, 24, and put him in confinement. He has been in jail since March 14 on driving under the influence and drug trafficking charges, records show. A charge of battery on a law enforcement officer has been added after Monday's attack.
The sheriff's office will send letters to the rescuers' attorneys to be used in court on the inmates' behalf, Previtera said.
That so many inmates came to Moon's rescue "speaks volumes for the respect he's garnered from these men under his control and in his custody," he said.
Haydee Oropesa, attorney for inmate Hoang Vu, said she hopes the Hillsborough County State Attorney's office takes into account Vu's actions.
"He is an inmate that acted with care and compassion to another human being,'' Oropesa said. "I hope it does help him."
Chris Watson, felony bureau chief with the Hillsborough County Public Defender's Office, said the action taken by the inmates won't wipe out the charges against them but might help during mitigation to possibly receive a lesser sentence.
"Is it possible that what they did could help these gentlemen?" Watson said. "I think yes. It's possible."
"We are certainly happy that someone stepped in to help someone who is in a vulnerable position," Watson said. "That people stepped up and protected the deputy is a great thing."
Watson said he has been at the Orient Road and Falkenburg Road jails and met with inmates in the open area where they are held. He said it can be intimidating seeing so many people in one closed in area.
"You have an appreciation for the risk those deputies take," Watson said.
Deputy Anthony Brown works in the unit and knows Moon and many of the inmates. He said the inmates' actions showed there is more to their character than the crimes they are charged with.
"You would think that they would walk away, so somewhere in their hearts, there must be some goodness,'' Brown said.
Brian Rogers is the sheriff's office's trainer for detention deputies. He said Moon did not have his radio holstered on his hip when he was attacked. The radio has a panic button that sends out a signal to jail officials that a deputy needs help.
"I don't think he had his radio on him at the time,'' Rogers said. "I think he just got surprised. The radio was on his desk and now he's kind of left helpless without any type of communication.''
Moon, a 22-year veteran, is home recuperating from his wounds.
He was stunned after watching the surveillance video of the incident.
"He is understandably shaken by this sudden, random and violent attack, and clearly he recognizes the ramifications of what could have happened in this situation," Previtera said

WESTMINSTER - A state correction officer who police said had been brandishing a handgun and making threats at a Fitchburg bar Sunday died after exchanging gunfire with police outside his home.
A spokesman for the Worcester District Attorney’s Office said Michael A. Membrino, 49, of Westminster, was pronounced dead at Heywood Hospital in Gardner shortly after the Sunday night exchange of gunfire with police.
Spokesman Don Xenos did not disclose whether Membrino, who was wearing body armor during the incident, was shot by police or if he shot himself.
He said the circumstances of the shooting remain under investigation.
The Massachusetts Department of Correction said Membrino was an officer at the North Central Correctional Institution, a medium-security facility located in Gardner.
Witnesses told authorities that Membrino had been brandishing a handgun while making threats at Partner’s Pub in Fitchburg earlier on Sunday.
Authorities did not divulge the nature of the threats Membrino was alleged to have made at the bar. Police later found Membrino at his home

Bridgewater, Mass. Correctional Facility Earns Energy Star Award for Significant Energy Savings

(Boston, Mass. – Oct. 6, 2009) – The Commonwealth of Massachusetts’ Department of Corrections Bridgewater Correctional Complex, located in Bridgewater, Mass., was recently presented with an Energy Star “Combined Heat and Power” award for using highly efficient systems to save energy, lower greenhouse gas emissions and reduce air pollution. The Bridgewater correctional facility was one of only four selected for national recognition in the EPA award.
Combined Heat and Power (CHP) generation is the simultaneous production of electricity and heat from a single fuel source, such as natural gas, biomass, biogas, coal, waste heat or oil. CHP is not a single technology, but an integrated energy system that can be modified depending upon the needs of the energy user. CHP (sometimes referred to as “cogeneration”) is up to 60 percent more efficient than producing heat and power separately.
“We’re excited that the Bridgewater Correctional Complex is setting the pace for other major facilities in New England and across the nation,” said Ira Leighton, acting regional administrator for EPA New England. “Reducing energy consumption through efficiency is just good common sense, and this facility is a role model for the region.”
The Commonwealth of Massachusetts Dept. of Corrections Bridgewater Correctional Complex received an award for using a CHP system that generates nearly 80 percent of its annual electricity demand and that meets the State’s nitrogen oxide (NOx) emission requirements without the need for add-on pollution controls. The CHP system operates with an efficiency of nearly 70 percent and effectively reduces greenhouse gas emissions equivalent to the annual emissions from approximately 600 cars.
"Congratulations to the Department of Corrections' Bridgewater Correctional Complex on winning the Energy Star CHP Award," said Massachusetts Department of Energy Resources Commissioner Phil Giudice. "Generating 80 percent of the complex's annual electricity demand on site and achieving significant greenhouse gas emissions, Bridgewater's combined heat and power system is a great illustration of the Commonwealth's public agencies 'leading by example' as we pursue Governor Patrick's vision of a clean energy future."
Conventional fossil-fueled power plants produce power with a typical efficiency of about 30 percent. The projects recognized by EPA in this award are reaching operating efficiencies of at least 50 percent
Since 1999, EPA has given the ENERGY STAR CHP Award to recognize organizations and institutions that install exceptionally efficient CHP systems. In 2001, EPA formed a CHP Partnership working with organizations to reduce the environmental impact of power generation. In addition, the partnership supports the development of new projects that have significant energy, environmental, and economic benefits.

A 44-year-old town man has been arrested and charged with the murder of a Kingston man in Carver in 2003, authorities said.
Darren Caswell, whose last known address was on Bedford Street in Middleboro, has been charged with one count of homicide in connection with the death of Matthew S. Cote, 26, said Plymouth County District Attorney Timothy J. Cruz.
Caswell was arrested Friday after a Plymouth County grand jury indicted him earlier in the day, Cruz said.
Caswell was scheduled to be arraigned in Plymouth County Superior Court in Brockton Monday morning, Cruz said.
Middleboro police Lt. David M. Mackiewicz said Caswell had worked as a corrections officer at a state facility in Bridgewater. Cruz said he did not have any details about Caswell’s background.
“Any and all information will be released at the arraignment,” Cruz said.
The arrest came after years of investigation into the death of Cote, of 17 Crescent St., Kingston.
His body was discovered about a quarter-mile off Tremont Street in Carver, on Aug. 17, 2003. The charred remains were found in the back of a pickup truck and identified by dental records.
It was determined that Cote died before the fire was set. First Assistant District Attorney Frank Middleton said at the time that Cote, formerly of Middleboro, died of multiple trauma.
Two years ago the case was featured on the national television program America’s Most Wanted.
Caswell was arrested by Mackiewicz, Detective Timothy G. Needham and state police detectives,

Corrections Officer Arrested In 2003 Murder
A retired Bridgewater, Mass. corrections officer has been arrested and charged with the murder of 26-year-old Matthew Cote.
Darren Caswell, 44, was arrested at his home and taken into custody on October 2, 2009, after a Plymouth County Jury indicted him earlier that day.
During his arraignment, he pled not guilty to the charges.
He is being held without bail. His next court date is scheduled for Oct 12, 2009.

E-mail Print (15) Comments Text size Share Buzz up!An Essex County correctional officer has been voluntarily burning up his sick leave this month in order to donate bone marrow to a 13-year-old stranger he may never even meet - all because Daniel Katz responded to a Be the Match Registry drive five years ago while a freshman at the University of Massachusetts, Amherst.
The sum total Katz, 24, knows about the life he may be saving is the boy is stricken with acute lymphoblastic leukemia.
“Whether I know him or not doesn’t matter,” the native Marbleheader said. “Someone who’s 13 doesn’t deserve to be going through that.”
In keeping with the physical demands of his job, Katz’s summer would more typically be spent running, lifting weights and shooting hoops with pals. Instead, he had surgery Aug. 5 - a series of needles stuck in his lower back to extract marrow from his hip bone.
“I couldn’t really walk for the (first) week, and I was told it takes about two or three months for the bone marrow to regenerate,” said Katz, who plans to be back at work by the end of the month.
“As his colleagues, we just think it’s an incredibly selfless act and he deserves a lot of credit for enduring this,” said Paul Fleming, spokesman for Essex Sheriff Frank G. Cousins Jr.
National Marrow Donor Program spokeswoman Catherine Claeys said only 30 percent of donors actually undergo surgery vs. the majority who donate peripheral blood stem cells. And of the 7 million people on the registry, only one in 200 “are actually ever called.”
Katz will receive updates on the boy’s health and, after one year, if the child’s family wants to make his acquaintance, Katz must also be willing to give up his anonymity as a donor.
But if that day never comes, Katz wants his marrow match to at least know, “There are people out there who care about others. He should grow up with that mindset

we need to vote all the e-board incumbents out of office in this next election. We are losing at every turn.

7) Executive Secretary Henry Harris is not even a correction officer-he is a brownshirt maintenance worker from shirley med.
8)Grievance Coordinator james Nason admits he still does not know his job and needs more time to learn.
This union has gone downhill for the past six to eight years under the so called leadership of these guys.
they might be good guys I don't know any of them. This is nothing personal. but they have had there chance.
Lets vote in some hardworking, smart and solid union guys who will work hard for us and NOT sell us out.

Lt Charlie Hierholcer has passed away. According to his family, Charlie passed away last Saturday after a long illness. Charlie was a thirty-plus year veteran of the State Hospital and Old Colony. Wake is at the Fairhaven Funeral Home this Wednesday the 15th from 3-7 p.m. and funeral is from the Fairhaven Funeral Home on Thursday the 16th at 10 a.m. Rest in Peace, Charlie.
