What is defamation, libel and slander?
Whether you are the victim of internet defamation or being wrongfully accused of internet defamation, you need to understand the law. In order for a comment, post or article to constitute internet libel, the following elements must typically be met:

The first thing you must prove is that the statement constitutes a false statement of fact. A fact is different than an opinion. A fact can be proven true or false. Opinions are typically not actionable as defamation. The false statement of fact must harm your reputation. There are many false statements posted across the internet. In order to constitute libel, a statement must not only be false but must harm you or your company’s reputation and cause harm.

The false statement of fact causing harm must be made without adequate due diligence or research into the truthfulness of the statement. Alternatively, plaintiffs often attempt to prove that the false statement of fact was made with full knowledge of its falsity.

If the person who is the subject of the false statement of fact is a celebrity or public official, the plaintiff must also prove “malice.” Malice is proven when the person posting the information on the internet intended to do harm or acted with reckless disregard of the truth in making the statements.

There is often confusion about the differences between defamation, libel and slander. In many ways, courts treat defamation on the internet similar to off-line defamation. But there are differences which you need to understand when the false statements are made on-line.

Defamation: An unprivileged false statement of fact which tends to harm the reputation of a person or company. This is a catch-all term for both libel and slander.

Libel: Defamation which is written such as on a web site. Most on-line defamation occurs through libel by posting a web page, comment, bulletin board post, review, rating or blog post.

Slander: Defamation that is spoken such as through an transcribed video, podcast or audio file.

I agree. Her videos and vlogs consistently demonstrate a lack of both poise and maturity. When you compare her credentials, her social media savvy and those other things you mentioned (professionalism and class) to contestants from some other states, the difference is astounding. Yes, as professionals we each get up every day and go to work knowing that we are representing not just ourselves as individuals, but also our job title and our employer/company's brand (depending on the situation). The same is true for Miss Illinois. Each titleholder will bring to the position a touch of their own personality, which makes them unique, but ultimately they are representing the brand of Miss Illinois and that requires careful consideration. What is posted on social media or in videos is open to the public and will be viewed by more than just the titleholder's close friends. Hopefully, when a new team is selected, there will be a group of individuals on a business management/media team who will monitor this process and assist in making sure that the overall image of the organization is appropriate and one we can all be proud of. Jane Ann Blindsided????? REALLY???? ....stupid people.... Did you watch the visual coverage? She is actually in the video that was taken as she was in her car driving Mark Angeli to the "Private" Secret meeting. NOT blindsided more like "IN CAHOOTS" Cant play both sides of the fence and not let it bite you in the ass later! She was exposed right then and there as a traitor! She sat in the corner of the hotel spying and stalking every day through pageant week. Had she spent more time doing what she was suppose to be doing as ED for the girls instead of seeing how many angles she could stir up in taking the board and the program down to make herself Queen would have actually benefited the program... and in the end she is gone too. Another used pawn from MAO. They DO know how to plant a mole!

Just another attempt to get the attention away from the people who really caused all the problems. It did not have to get to this point but MAO just ignored everything and it finally blew up in their face. They have smeared everyone in the organization trying to make them look bad. Subject: What qualifies someone to be a pageant judge? I know some systems have their own certifications, and some don't. Some systems use those knowledgeable in the entertainment or speaking fields, former titleholders, etc. What kind of experience should one have?

First and foremost, they should have an education. Second, they should not be one of the five judges from Miss Illinois this past year. Those five should be banned from judging in the state of Illinois for eternity. Former titleholders are always an asset to a panel because they understand what it takes to uphold the title. I agree! I believe Crystal's selection was AS's parting gift and her way of giving the middle finger to everyone else involved in the program as she was being forced out the door. I think Crystal (whose dishonesty makes me unsympathetic toward her) couldn't have dreamed of a better year. It's a year without Amalia, with few expectations and responsibilities compared to other formers, and with people who are offering to help her, financially and otherwise, because they are clamoring for a favorable position in the organization. Being "deserving" should not be left up to someone's discretion, particularly a person who no longer holds the contract, but rather it should be a set amount the winner is contractually entitled to have. Grace was one of the most talented and articulate ladies this pageant has seen. Too bad the board chose to tear down a teenager and then force her to wear an ill fitting gown when her state gown had been perfect. No this is not her mother, but someone who knows the whole story. As someone who competed with Grace, she is the farthest thing from a poor representation for our state. She was always so kind and she is honestly one of the most intelligent, talented, and hardworking individuals I've ever met. I was glad she beat me, because she deserved it. She's been on Broadway and won a 20,000 dollar scholarship for her platform work. And you know what? I'm certain that this was the year Grace dreamed of. I know when I talked to her Mom at the Reception they were done with this organization and were happy to be gone and disappointed that other states have great leadership and provide wonderful experiences for their titleholders. I hope this State gets its act together because this experience shouldn't be like this for titleholders. I know Grace and her family well. Try to endure a year of service with ISA organization. This organization was never about the titleholders, but about themselves. Maybe if your daughter had won, she'd have a puss face as well. And you would have been threatened by Glen or your daughter would have had no support from Teen Director. And after all of this, your daughter would be the one they were bullying. Anyway, think about it, you might feel the same way. I also am so ashamed of these posts. Contact your health insurance - some insurance companies provide psychiatrict help. I don't know how many girls have an anti bully platform, but posting on a anonymous board like this is horrible. With all this defending/crucifying of Grace, etc, you guys have done exactly what Amalia wants: taken the attention off her and put it elsewhere. Regardless of whether she was an angel or not, regardless of whether or not she and her mom pleased "the boss," Grace (and many others like her) deserved the same treatment Peyton has gotten simply by virtue of being the titleholder. Amalia continues to manipulate the flow of money that doesn't belong to her however she wants and you guys want to argue with her over who's crazier. How similar or different is this state pageant in cost especially from MAO? I haven't seen any info released about prelim nights like MAO does and am trying to plan accordingly. Cheaper, more expensive? Seeing as its September 4-7 who competes when? Help please and thank you! =)

IL USA has a fairly new director/management. Numbers have been down but the chances of winning based on actually merit has gone up. Emily Travis is competing at Miss Illinois USA. She was such a pleasure to watch in the Miss America Organization. She is beautiful, bright, and kind. I knew she would grow into a lovely young lady when she represented us as a teen. I only wish she had been able to represent our program in Atlantic City. I hope that the USA program gives her more respect and credit than the Illinois America program ever did. She deserved so much more recognition for what she brought to our stage. So the formers were waiting to talk to MAO. Consensus was no media involvement. Who jumped it and went to WGN? Obviously it was someone who wanted more than a solution. You could tell by the news video that Jane Ann had been blindsided.

Any one of the thousands of people who follow pageantry could have tipped off WGN to the Change.org petition. The formers, parents, volunteers, and contestants had been waiting 9 years -9 YEARS- for the MAO to do something. How long were they to wait before they were to contact the media? 10 years? 15?? Make no mistake, the ONLY reason the MAO came to Merion, IL was because of the medias involvement. The ONLY reason AS was FINALLY dealt with by the MAO was the medias involvement. For clarification, Doug Black's treatment in WI had nothing to do with Christina Thompson. He worked with several Miss Wisconsins after her. Where he got a raw deal was getting falsely accused of taking Laura to Fran Skinner and her Dream Team. When MAO found out that Laura had worked with Fran, Amalia and MAO threw a fit and called the WI directors. He got thrown under the bus for Laura working with Fran, which was absolutely ridiculous. He was just used as a witness in one of their investigative reports and their investigation of him would reflect poorly on the thoroughness and credibility of that report. During my time as a volunteer, Amalia made up the rules as she went. Didn't matter what the by-laws said or what was in the MAO agreements, she just made up rules as she went, and used them to punish people. I visited this board to get some information on pageants in Illinois because my 10 year old did a fair pageant and now has the desire to do more. All I can find is people yelling about things I don't understand. Is there any area on this site that either 1. Explains what all of the fighting is about, or 2. Gives actual information about pageants? I've tried Pageant Planet but it just gives me links that are mostly not updated. I would really like to be able to find a site with good information and some actual advice. Thanks in advance.

Not really. The state pageant did everything right by her. paid for everything. Trainer. Nutritionist. boubght all her clothes. Paid for trip to DC. Paid for musical arrangement, make up , hair etc. She apparently lost a ton of weight befor the state pageant and when she went to order all of her wardrobe items they were made in the size she was when she competed at stat. Most girls lose weight before Miss A. Unfortunately she gained so much weight there was no more room in the seam allowances to let out the clothes. Her choice. The state paid for her to go to the Toronto Airport School of Ministry. A room at th airport with computrs linked to a preacher in Louisian. She knew it was her obligation to return for the state pageant on her own dime. The state did everything they usually did for contestnats, full page photo, full page in book about her year, put her in the show etc. She sent a lettr resigning before the state pageant because she did not want to pay the costs to come back from Toronto. She sent a very nasty letter with her resignation and asked the state to have the emcee read it to the audience. The state complied and had it read to the audience. Further down, someone posted the following reply, which needs to be highlighted in its own separate post and gets to the heart of the problems within the Miss Illinois Program the last nine years:

"The POINT is....the WGN story is a complete load of crap and some of ( ALL OF) the people on the panel are not credible. You have a stalker, some chic that got fired because ahe bounced checks and the Teen ED, a few other chics that didnt follow the rules and were put on probation, a pissed off parent ( what else is new?). The point it not to deflect....the point is, people are taking what these 8 people are saying and running with it. They are NOT reliable resources and these stories are made up, hearsay or completely embellished. People are STILL afraid to speak the truth....what sort of backlash would there be? Especially now with AS out? They're cowards! The petition included A LOT of people that never even met AS and had absolutely nothing to do with the organization. Friends of friends of friends signed that thing. It's not too difficult to get 250 signatures. People just believe any old bullshit these days....."

This post could only come from about three or four different people. The denial speaks volumes. So now they are claiming that everyone who appeared in the WGN story is not credible, as well as the people who signed the petition.

To the poster of this drivel, YOU miss the point. For the 11 people who appeared on WGN to speak out, there are at least ten people who didn't step forward who had similar experiences. I was first contacted by WGN this past April, and for everything they asked me on the phone, they asked for proof or verification. This report was not thrown together in a couple of days and went way beyond the people shown on camera. WGN spent MONTHS pouring through individual testimonies, letters, emails, etc. to validate their story. We've also confirmed that between letters to MAO, the on-line petition and meetings with Angeli that eight Miss Illinois titleholders stepped forth to express their frustration over their year. Tell me how many other states in the history of Miss America have had EIGHT titleholders in nine years demand change!

The real pathetic part is how deep the denial runs, when the numbers of people negatively impacted speaks volumes. Guess what? If all of those people who left the organization over the last nine years were bad and eight out of nine Miss Illinois titleholders were "spoiled brats" with "another pissed-off parent" that still reflects poorly on A.S. and her board of hand-picked puppets. After all, it was A.S. and her Board who were responsible for bringing in volunteers and selecting the judges who were supposed to give then an "manageable" Miss Illinois. So if all of those people were bad, then all of this still falls back to their FAILED LEADERSHIP!!!!

To this small group of people still in denial and trying to claim that the WGN story was fabricated b.s.: you really need help. I don't make that statement as a cut down or slam. I say that constructively, in that you really need some counseling or some sort of help to face the reality of the bad culture you created within this program for nine long years. I take mental health seriously, and the best thing you can do is just get yourself some help and move on. Volunteer in different venues; throw yourself into your job; spend time with your family; take a vacation, but for your own sakes, move on and accept the responsibility. Learn from the failure and move on.

Each titleholder will bring to the position a touch of their own personality, which makes them unique, but ultimately they are representing the brand of Miss Illinois and that requires careful consideration. What is posted on social media or in videos is open to the public and will be viewed by more than just the titleholder's close friends. Hopefully, when a new team is selected, there will be a group of individuals on a business management/media team who will monitor this process and assist in making sure that the overall image of the organization is appropriate and one we can all be proud of. First and foremost, they should have an education. Second, they should not be one of the five judges from Miss Illinois this past year. Those five should be banned from judging in the state of Illinois for eternity. Former titleholders are always an asset to a panel because they understand what it takes to uphold the title. IL USA has a fairly new director/management. Numbers have been down but the chances of winning based on actually merit has gone up. USA is more expensive to compete in all the way around from entry fees to prep and wardrobe etc. IMO it's more fun and less stress. Instead you chose to separate people from one another, cause strife, gossip, and worst of all, intimidate young women into succumbing to your bidding, or fear losing their titles. As someone who has worked with young adults for many years, I highly doubt that this is good or effective training to become successful. Is in black and white what she can and can't do but some titleholders broke rule after rule in their contract (which is re worded from MAO contract). She sent a very nasty letter with her resignation and asked the state to have the emcee read it to the audience. The state complied and had it read to the audience. Unfortunately for her Tara Dawn Holland also got th message from God and I guess that message was true! LOL. You have a stalker, some chic that got fired because ahe bounced checks and the Teen ED, a few other chics that didnt follow the rules and were put on probation, a pissed off parent ( what else is new?). The point it not to deflect....the point is, people are taking what these 8 people are saying and running with it. They are NOT reliable resources and these stories are made up, hearsay or completely embellished. People are STILL afraid to speak the truth....what sort of backlash would there be? Especially now with AS out? They're cowards! The petition included A LOT of people that never even met AS and had absolutely nothing to do with the organization. Friends of friends of friends signed that thing. It's not too difficult to get 250 signatures. People just believe any old bullshit these days....." This post could only come from about three or four different people. The denial speaks volumes. So now they are claiming that everyone who appeared in the WGN story is not credible, as well as the people who signed the petition. To the poster of this drivel, YOU miss the point. For the 11 people who appeared on WGN to speak out, there are at least ten people who didn't step forward who had similar experiences. I was first contacted by WGN this past April, and for everything they asked me on the phone, they asked for proof or verification. This report was not thrown together in a couple of days and went way beyond the people shown on camera. WGN spent MONTHS pouring through individual testimonies, letters, emails, etc. to validate their story. We've also confirmed that between letters to MAO, the on-line petition and meetings with Angeli that eight Miss Illinois titleholders stepped forth to express their frustration over their year. Tell me how many other states in the history of Miss America have had EIGHT titleholders in nine years demand change! The real pathetic part is how deep the denial runs, when the numbers of people negatively impacted speaks volumes. Guess what? If all of those people who left the organization over the last nine years were bad and eight out of nine Miss Illinois titleholders were "spoiled brats" with "another pissed-off parent" that still reflects poorly on A.S. and her board of hand-picked puppets. After all, it was A.S. and her Board who were responsible for bringing in volunteers and selecting the judges who were supposed to give then an "manageable" Miss Illinois. So if all of those people were bad, then all of this still falls back to their FAILED LEADERSHIP!!!! To this small group of people still in denial and trying to claim that the WGN story was fabricated b.s.: you really need help. I don't make that statement as a cut down or slam. I say that constructively, in that you really need some counseling or some sort of help to face the reality of the bad culture you created within this program for nine long years. I take mental health seriously, and the best thing you can do is just get yourself some help and move on. Volunteer in different venues; throw yourself into your job; spend time with your family; take a vacation, but for your own sakes, move on and accept the responsibility. Learn from the failure and move on.
