What is defamation, libel and slander?
Whether you are the victim of internet defamation or being wrongfully accused of internet defamation, you need to understand the law. In order for a comment, post or article to constitute internet libel, the following elements must typically be met:

The first thing you must prove is that the statement constitutes a false statement of fact. A fact is different than an opinion. A fact can be proven true or false. Opinions are typically not actionable as defamation. The false statement of fact must harm your reputation. There are many false statements posted across the internet. In order to constitute libel, a statement must not only be false but must harm you or your company’s reputation and cause harm.

The false statement of fact causing harm must be made without adequate due diligence or research into the truthfulness of the statement. Alternatively, plaintiffs often attempt to prove that the false statement of fact was made with full knowledge of its falsity.

If the person who is the subject of the false statement of fact is a celebrity or public official, the plaintiff must also prove “malice.” Malice is proven when the person posting the information on the internet intended to do harm or acted with reckless disregard of the truth in making the statements.

There is often confusion about the differences between defamation, libel and slander. In many ways, courts treat defamation on the internet similar to off-line defamation. But there are differences which you need to understand when the false statements are made on-line.

Defamation: An unprivileged false statement of fact which tends to harm the reputation of a person or company. This is a catch-all term for both libel and slander.

Libel: Defamation which is written such as on a web site. Most on-line defamation occurs through libel by posting a web page, comment, bulletin board post, review, rating or blog post.

Slander: Defamation that is spoken such as through an transcribed video, podcast or audio file.

I thought from the beginning this pageant was fixed. The winners were prechosen. So much money wasted for nothing. It is sad for the parents and contestants who spent a high amount of money for the trips to the practices, trips to the meetings, trips for "appearances", money money money. Cab fees, entry fees, coaching fees, and it was a prearranged pageant from the beginning. The Teen winner already held various titles and was his chosen winner before it started. Truly sad for the girls who really tried and are fair. Wonder if all funds will be returned to all contestants.

I am so happy that local pageants are back in session and the America program is back in action! I know confirmed ones have been posted on the website, but does anyone else know of any locals that could potentially be posted? What is in central and southern illinois?

Ashley .hatfield is a joke. She positioned herself as some spokesperson for all of the formers and fed MAO some line of bs like she is some respected leader in the state. What a joke. It is not a Miss Illinois prelim, so it isn't related to our organization and I hope we don't get any bad PR from it. I think it has to do with a child winning Marion Main Street, but her mother was a co-director/volunteer. When she won people complained that it was a conflict of interest. The issue is that the Board knew about it in advance They were fine until one person complained. If it was an issue, they shouldn't have let her compete. It did not violate any rules. There's a difference between acknowledging the past and wallowing in it. I think the OP was just asking for a positive new outlook. But your post proved that's impossible for some people to move in a positive direction, and for the board to move in a positive direction, as long as there are those who are willing to personally attack people they don't know, calling them "stupid," and assuming they've been repeatedly taken advantage of. I think that Miss Illinois is lucky to have a leader at all. There is going to need to be clean up and what do they pay the ED (if you don't take from the organization) NOTHING! I think everyone should be thrilled that Ashley was selected. I can't even imagine what this organization would hve been in Illinois without a former. Let's all remember she has to rebuild. Where do you keep getting that she claimed to be the leader of the formers? If anything, knowing the way MAO felt about formers, that would not have been something to recommend her in their eyes. She did not stand silent, nor did she keep herself in the "spotlight" by continuing to participate in the program. It's very self-important of you to think that whether or not you are "impressed" matters. It matters as little as why you think she has anything to prove to you. Ashley comports herself professionally and will be an excellent ED. She may not make a lot of friends, but that's mostly because I don't see her participating in all the game-playing that has become commonplace in this organization. Your opinion is interesting given the wide acclaim and the outcry of support the announcement received on the Pageant Guru, where people not only remembered her, but repeatedly commented how much they loved her when she competed and had her tagged as a forerunner when she went to MA. She won all her preliminaries at the state level. She knows a thing or two about competing and she knows a thing or two about style. She is educated, knowledgeable, professional and fair. Whatever your concerns are, I suspect they're because she hasn't handled things the way YOU would have liked. I also suspect you won't be impressed and there will never be substantial proof for you, no matter what she does. But I appreciate that she isn't easy to bully and has the confidence to handle things in the way that feels right to her. Ashley's going to be a great ED. I dismiss postings on Guru because it's like listening to Joel Osteen where everything is sugary sweet. The minute someone posts something that's not sugary sweet it's deleted. Ashley certainly had all of the components to be competitive at Miss America, but the truth is she blew it at Miss America. Not sure if she made a bad choice or allowed herself to be misled by Amalia. Regardless, her road to Miss America ended the night she did talent in Las Vegas. It was a subpar performance and took her out of the competition. Hopefully Ashley makes better judgments as a State E.D. In regards to Ashley remaining quiet, I don't have knowledge of what she said or didn't say to MAO, BUT I also know that if paranoid Amalia had any suspicion that Ashley was talking to MAO behind her back, Ashley would have been on the brunt end of a smear campaign. Your version of how Ashley continued to be involved is based on your speculation, not fact. But, yes, her lackluster LV performance was largely due to Amalia's influence (or flat-out insistence) on her talent, not her lack thereof. Those are not my details to share. They're Ashley's and she gets to decide whether or not she wants to share them, with whom and when. It's unlikely she'll ever check this board, much less post on it. We should all be thankful for that, given our history with the previous ED. Plus, I'm not sure how relevant those details are now anyway. MAO knows how she handled her conflicts, what she did/didn't say and, being informed, they chose her to lead the program. Ms. Hatfield served as Miss Illinois 2007, and as a result of the scholarship awards she received from participating in the Miss America program, she obtained a Master of Science degree in Communications Disorders and started her career debt-free. She made the Chancellor’s List, graduated Cum Laude, and now works as a speech language pathologist in the Illinois Department of Human Services.

Well, we don't know what her score was for that and it counted for so little of the overall score. There's no question she did well in talent, evening gown and swimsuit. They alluded to liking her in her interview as well. I assume her preliminary composite score was high. So, that's why she was rewarded-for being a well-rounded competitor. She's done pretty well during her media tour so far and seems extremely likable, not to mention immensely talented and beautiful. The point was that this person, and apparently others, launch ad hominem attacks against people instead of actually defending anything. An ad hominem attack is defined as "Attacking the person making the argument, rather than the argument itself." It's usually made out of desperation when one can't find a decent counter argument, which I have yet (but would be very interested) to read. Now, I can't speak for all of them, but I would assume that the people who have commented weren't responsible for Crystal's choices, so their education, style, etc is really irrelevant. It is not a Miss Illinois prelim, so it isn't related to our organization and I hope we don't get any bad PR from it. I think it has to do with a child winning Marion Main Street, but her mother was a co-director/volunteer. When she won people complained that it was a conflict of interest. The point was that this person, and apparently others, launch ad hominem attacks against people instead of actually defending anything. An ad hominem attack is defined as "Attacking the person making the argument, rather than the argument itself." It's usually made out of desperation when one can't find a decent counter argument, which I have yet (but would be very interested) to read. Now, I can't speak for all of them, but I would assume that the people who have commented weren't responsible for Crystal's choices, so their education, style, etc is really irrelevant.
