Subject: humane society keeps mothers dog

what rights do you have when someone picks up your dog asuming the dog is a stray? my mothers dog was picked up by someone almost in front of my mothers property,i'm sure by a concerned person,according to the news paper ,the little dog was nearly hit by a vehicle or vehicles. he was in this weeks paper listed with the humane society,a cousin called to see if it was my mothers dog that had been missing since feb. 24 .my mother had assumed he was dead,or stolen. we contacted the humane society to claim him and was told she would have to adopt her own dog back, is this reasonable or lawful?? oh, and the adoption fee is 75.00 . and of course my mother can't prove the dog is hers because she only had him 2 or 3 weeks and has no pictures.
