Subject: Profiteering from CC Resources

I ought to start this post off with a disclaimer: I'm not completely innocent. I have performed a VGA mod in exchange for cash, but I did it because the guy 1) was local to me and 2) came to me asking me to do it. It's not like I actively go seeking people to have me do their VGA mods for them. I'd much rather talk someone through it myself than actually do the work for them. That said...

Bertie makes an excellent point in the previous post, where she says:

I think the Takky pioneers just said something like, "Please don't do this for profit." Ours should say something like, "Do this for profit, and IT WILL COST YOU DEARLY" or something to that effect.


It is very sad to see the good intentions, hard work and a lot of money from many good people getting stolen and used for profit without even a mention of where the info came from or compensation to its owners.


So, who wants to work up a disclaimer with me? I was thinking something to the effect of the following:

The information contained herein is to be used for personal, nonprofit use ONLY. By using this information commercially, you agree to pay the administrator of this site 50% royalties on any profits you realise from the information herein.


The biggest problem I see with the above is that it fails to explicitly define "commercial use." IMO, what "Smithfamily1" is doing is *definitely* commercial use. He (probably a he, anyway) is making PCCs with the clear intention of selling them at a profit. What I did was *not* commercial use. If someone makes a PCC and then decides to move on to bigger and better things, I have no objections to its sale. Even Ballchai put his on eBay when he was ready. For the most part, these things are one-off jobs, but Smithfamily1 has turned it into a commercial operation, and that's where I draw the line.

It also fails to take into account the various contributors who are *not* administrators of, for example, this forum or the CC FAQ (i.e., anyone but Stuart or myself). Personally, I would be happy to speak with any major contributors to the CC FAQ about compensation should such a situation arise, but if you pointed out a simple typo, don't expect me to listen real seriously to you. (I'm thinking more along the lines of people like Al Miner, who essentially did the entire Zip-in-a-CC thing himself. I just edited his material a bit.)

Feel free to argue amongst yourselves about it; I'm quite curious to see what it might lead to.

And yes, I realise the extreme difficulty of actually *enforcing* such a "click-through" licence agreement, but I also know how paranoid eBay can get if you give them evidence that an auction item might be stepping on some legal toes. I don't care if I never see a dime as long as that guy stops trying to make a fast buck off *my* hard work.
