about the merits of your precise argument, but judging from other locales, I think it's apparent that there is legal standing when it comes to banning smoking from all public spaces. NYC has had a ban in restaurant dining rooms for some time and the Council/Mayor just passed legislation banning smoking from all bars, except those that were created primarily as a place to smoke - i.e. cigar bars (would kind of defeat the inherent logic if cigars were banned from such establishments). While I know of no appeals of the earlier ordinance, I'm quite certain it would've happened if such a case had merit, given the large and vocal oppostion to all such laws.

Personally speaking, I think your argument is sound.
