For example, premeditated murder is considered more severe because the person planned and fully intented to murder a person, which is more severe then say a mugger who killed their victim during a struggle without intending it beforehand.

And you are the one putting forth fiction. Hate crimes laws do not make hatred a crime. You can hate anyone you want as much as you want.

WHEN YOU ACT ON THAT HATRED BY COMMITTING A CRIME THEN YOU HAVE CROSSED THE LINE AND BROKEN THE LAW!!!

It is not a difficult concept to understand and it has been repeated many many times. This idea that hate crimes laws criminalize anyones thoughts is completely FALSE. It is a lie that has been promoted by people who oppose any protection for gay people. Just as it is perfectly legal for the KKK to hold a public rally and preach hatred of minorities, but it is illegal for them to act on that hatred and committ assaults, vandalism, or murder against people.

Can you show me a single case in which a person was convicted under a hate crimes law for being hateful, for having hateful thoughts, or for their speech without having committed a crime? Even after a crime has been committed, hateful thoughts or speech is not criminalized. It is used as proof to show the person's motive and/or intentions. Motives and intentions are taken into consideration in any murder case, and most other cases as well. It is NOT something specific to hate crimes law.

Those are facts.
