I asked around and it's rare for an attorney to turn a judge in on that rule for obvious reasons (you have to work together or appear in his/her court at some point)- you do it only when it has really gone too far. For it to happen twice seems to indicate a pattern especially if the action wasn't filed by the same attorney.
All that experience she talks about is meaningless if she doesn't learn from her mistakes.
I'm voting for Miller.
