Isn't jud mcmillan representing nickengard a conflict of interest? They both have a vested interest in this case,
I mean after all if they win they both will get to share in the spoils or in this case the property and money.
Everyone already knows how its gonna go after all what Nickengard wants he gets!! Wonder what will happen to all the money once these 2 get ahold of it?

What's happening? Has the city complied with the subpoena? I find that the FBI probably has some good targets in sight. Such as the mayor, council members, clerk-treasurer, a lot of business people who are receiving funds from the city and using it for personal gain and others who have never paid on their loans. Many people know the level of corruption in Lawrenceburg. The city should cancel all "executive sessions." This is their way of hiding things from the public. They can't seem to accomplish anything that really helps the citizens. Ask yourself some questions. What does Lawrenceburg do with a $68 million dollar yearly budget? What are the mayor's skills? Does council understand their powers? Why did the city attorney quit? Why can't the clerk-treasurer find missing funds? Why is the state looking to take the city's funds and appoint an administrator to run the city? Who and what businesses do you think should be scared of financial and legal penalties?

Events this past week elicited mention by a neighboring Sheriff that we should once again allow off duty police to use their official vehicles to keep the appearance of a police presence around the Counties.
The local jail project expenses has exacerbated budget concerns, and I rarely see cruisers around the County as I used to. I assume they are strapped in order to get the jail built.
One item that was practically "free insurance" for taxpayers, was to allow off duty officers to use their vehicles, (if they chose to do so). It is a police presence for free, and yet people complained about expense of County vehicle use.
We owe our officers a lot for what they do.
The presence of a vehicle out in public could make a difference to one of us at some point. I do see them parked at homes, but assume they are not allowed to burn gas for personal use.
Just plain unfortunate not to use these marked vehicles 24/7.

do you remember back few years ago when gas prices went soaring upward the reason we as a country was given was that the price of a barrel of crude oil jumped to over 100 dollars a barrel? well if that was true then why is gas is over 3.00 a gallon, crude is down right now its at 93.00
a barrel up from the 83.00 a barrel it ran for months and
months but still below the 100. dollars a barrel that was
supposed to be the reason for the jump in the first place,
not to mention that cars and trucks are getting better milage that just a few short years ago, and the demand across the whole planet is down, but yet here we are still
paying over 3.00 a gallon. diesel is ever higher which makes no sense since it is easier and cheaper to produce but because the nations trucking industry runs on diesel
they leave the price high for higher profit margings while us as consumers have to foot the bill not only at the pump but in the stores too because prices get marked up because of the delivery prices that are up because of diesel prices being up. what a nasty cycle we have come to accept as normal~!! we need the big oil people to held accountable!!

So Brewington goes to prison for allegedly intimidating the Judge, his wife, and some other individuals and the Judge issues an order in the Lopez case saying that he "felt it critically important to show that neither he, nor others involved in the legal system, will be intimidated from carrying out their duties..." So why was Brewington charged if the Judge and others weren't intimidated. Is Lopez getting a fair shake or did Brewington get screwed by the witnesses who testified against him. What is the truth? Where is the justice? Anybody ever heard of perjury?

What are the requirements to become a coroner? As with all other constitutionally elected officers, one need to be an elector of the county, and a resident for one year in order to be elected. The coroner does not perform autopsies (unless also a board-certified pathologist).
The coroner is an administrator above all else. By living locally and being elected, the corner is answerable to the people. The coroner has innumerable experts to call upon to help them render a decision. The Indiana State Coroners Training Board has been established and funded to provide 40 hours of basic training and 16 hours of annual cont ed for coroners to assist them in the administration of their duties, and establish mandatory training leading to certification.

So only two people remain charged in the Acapulco Case. 107 (that's a lot of people!) had their charges dismissed last week.
How long did the taxpayers house these alleged criminals(at least those who couldn't make bond) in our jail before the charges were dismissed?
Why such a vigorous beginning to this case and now we have basically a case of unpaid or perhaps underpaid taxes?
How many man hours went into this seemingly simple case?

(Hanover, Ind.) - An ex-student at Hanover College has been sentenced for a breaking into a dorm at the school and stabbing a student.
Demetrius Jones of Columbus was given a two year prison sentence by a judge in Jefferson County on Wednesday, 95.3 WIKI reported. Jones, 22, had pleaded guilty in July to a felony charge of Criminal Recklessness for the October 2011 attack.

Jones has also been ordered to pay $3,156 in restitution to the victim, Vincent Johnson.

Jones – who had been going to Hanover in pursuit of an education degree – can have the conviction reduced from a Class C felony to a Class A misdemeanor if he stays out of trouble for the next three years and pays the restitution. Prosecutor Chad Lewis said the sentence is balanced enough to allow Jones to seek future employment as a teacher, a profession which most states require applicants to be free of any felony convictions.

The stabbing followed a confrontation at a fraternity party earlier in the evening.

Now who wants this guy teaching in their school 3 years from now? Can I get a show of hands? Makes you wonder why in the world bad shit would ever happen in a school huh!

what a sad event. makes me cry everytime i think about it,
20 babies and 6 adults lost forever, what is even sicker is the fact that gun sales are up!! have we leared nothing? what is wrong with america the people care more about their guns than human life, how sad. i am not saying get rid of all guns but come on assult weapons are not needed. arming teachers is not the answer either

The 8th Amendment to The U.S. Constitution states “Excessive bail shall not be required...” Here is a link to a summery of Dan Brewington’s arraignment as well as to the transcript itself. Read how Dearborn County Deputy Prosecutor Joseph Kisor asks for a high bond in order to prevent Dan Brewington from blogging (talking) about the States prosecution of him. (In order that the PROSECUTION get a fair trial... no kidding) Also read how Kisor explains that disdain for the court or a lack of respect for the prosecutor’s office is also a reason for high bond. (and note that Brewington voluntarily presented himself anywhere and any time law enforcement asked him to)

In an unrelated criminal matter Lawrenceburg attorney Doug Garner filed a motion, December 3, 2012, stating that Prosecutor Aaron Negangard is using bail as an enforcement tool and a Judge is abdicating his duty to set bond to the Prosecutor... It is time for Judges like Sally Blankenship and James D. Humphrey, as well as the prosecutor’s office, to understand that their seemingly arrogant view that they ARE the law needs to end. Only then can they begin to understand ACTUAL law and the legal processes they are abusing.

Eagle 99.3 reports that the defense attorney for a restaurant owner accused of Corrupt Business Influence, Fraud, and Identity Deception wants the judge on the case removed. Adolfo Lopez remains held in Dearborn County’s jail on $3 million surety bond and $250,000 cash bond after an earlier request for a lower bond was denied November 21 by Dearborn Circuit Court Judge James D. Humphrey. Lopez’s defense attorney Doug Garner filed a motion on Monday titled “Motion for Removal of Judge James D. Humphrey Because He is Biased in Favor of the Dearborn County Prosecutor, Aaron Negangard.” Garner’s motion asks that Humphrey grant a change of judge in the case or recuse himself so that a special judge can be appointed. “Judge Humphrey acquiesced or participated in a procedure employed by Mr. Negagnard to use bond as a tool of law enforcement to obtain statements from co-defendants Mr. Negangard would have been otherwise unable to obtain,” Garner’s motion states. Three former Acapulco’s employees who had been arrested and released on bond testified on behalf of the state during a November 15 bond hearing. The motion alleges that Humphrey has ceded control of who is released on bond in the Acapulco’s case to Negangard. In an affidavit attached to the motion, Garner listed reasons backing his argument. Garner said during Adolfo and Maria Lopez’s initial hearing on September 25 he approached the bench and observed a hand-written chart listing the bonds set for the Lopezes and other co-owners.
“Counsel reasonably believes the Court determined the amounts of those bonds prior to the initial hearing,” Garner stated in the affidavit. Another allegation made is that many of the co-defendants in the Acapulco’s case had their bonds set or reduced only after waiving their Fifth Amendment rights and providing statements to the prosecutor.
Gardner said the “facts suggest the prosecutor is determining which defendants are being released on bond in the Acapulco Cases and the judge of this Court is assisting with the prosecutor’s use of pretrial incarceration to force the waiver of constitutional rights.” He added that a defendant waiving their constitutional rights is not an appropriate factor in setting bond, under Indiana law.
The motion for the judge’s removal also states that Humphrey was a victim in a recent case that Negangard prosecuted. Blogger Dan Brewington is serving a five year sentence for convictions of Intimidation of a Judge, Intimidation, Attempt to Commit Obstruction of Justice, and Perjury.
Humphrey and Negangard each attended an Indiana Court of Appeals oral argument in Brewington’s case held the morning of November 21 in Indianapolis. That afternoon Humphrey issued a ruling to uphold Adolfo Lopez’s high bond.
Garner referenced prior Indiana case law stating that the issue is not whether the judge believes himself to be impartial, but whether a reasonable person aware of all the circumstances would question the judge’s impartiality.

Eagle 99.3 News sent Negangard an e-mail inviting him to respond to Garner’s motion on Monday afternoon. A response was not received as of the publication time of this article

Just saw in the public records that the cheerleading coach at Greendale Middle School was arrested for DUI (.15). I don't think that sets a very good example.

A man and his niece were hospitalized as a result of a head-on accident between two ATVs on Sunday afternoon, according to Indiana Conservation Officers.
The accident was reported at about 3:54 p.m. on Lauman Road near Moores Hill, said ICO Cpl. Chris Powell. Michael Langdon, 40, and his niece, Emily Langdon, 11, were each driving an ATV on a ridge line in opposite directions when they collided.

Both Langdons were taken to the hospitals in Cincinnati by aircare. Their current conditions are unknown.

Powell said the crash remains under investigation.

I THOUGHT IT WAS ILLEGAL FOR CHILDREN TO OPERATE ATV'S UNDER THE AGE OF 16? CAN SOMEONE CLARIFY THIS FOR ME?

How does a committee charged with fleshing out the details of a schematic of the jail go back to redesigning it and then asking for more beds?
How many beds in this drawing are for programs like J-CAP?
How many beds are for people awaiting trial or sentencing?
And how many people in J-CAP are awaiting trial or sentencing?
Who is on this committee? Any unbiased taxpayer representation?
