THIS GOES TO A FULL SENATE VOTE..... Make sure that each and every Senator who represents your district knows about SB210 by Monday, 1/30.
We cannot stress enough how critical it is that each and every solid waste district director, each mayor, town councillor, county commissioner and county councillor from your district get on the phone with or meet with your Senator by Monday (before the full Senate vote). We are also asking you to reach out to others who have a lot to lose, and have them contact their Senator with the same message - SB210, as written, is bad for Indiana! Accept the amendment regarding funding or VOTE NO!

We need to try desperately in the next few hours to make every possible Senate contact we can in an effort to sway Senator Kenley from calling a vote on SB 210 on Thursday morning (9 a.m. hearing in Room 431 - no public testimony will be taken). More importantly, EVERY DISTRICT FUNDED THROUGH PROPERTY TAXES, needs especially to make this call to your Senator NOW! Though Senator Kenley seemed ready to mull over this issue (possibly through a summer study commission), the latest report is that he might well take a vote on Thursday.
Our message is simple:
1. Taking away property taxes for the district is bad for our community and bad for Indiana! We do not want the state determining how a district is funded and we do not want the state to take away our community's ability to fund itself through property taxes. Then, go on to tell them all that will be lost without property taxes. Dearborn County Solid Waste received about $600,000 from property tax (rate = $.0257) and about $100,000 from other sources in 2011. Without property tax the District may close as early as January 2013.
2. Urge Senator Kenley to hold (not take a vote on) the bill at the Thursday morning Appropriations Committee meeting.
3. If he does take a vote, encourage Kenley to strike the property tax language that will be so detrimental to 47 (more than half) of the state's solid waste districts.

Do you believe in the benefits of recycling? If so, we need you to take action now!
Senator Gard has introduced SB 210 that, if passed, will eliminate the authority of the solid waste districts to impose property tax. Without an operating landfill, Dearborn County is dependent on property tax for its existence.
If you do NOT want to see the Recycling Center close its doors, CALL or EMAIL your representative today, as the first hearing of SB 210 is tomorrow at 8 am. Let him know that you oppose SB 210 and why!

In an article “Car back in city hands” councilman-elect Joe Milish compared the misappropriation of city property to that of buying a package of hamburger at the grocery checkout. He likened buying $3.99 worth of hamburger and having it ring up at .99 as no fault to the buyer, because it was a computer error. As I see it the buyer has a moral obligation to correct the computer error, just as I know that Milish would want the same computer error to be fixed if it occurred on his first city council paycheck. Then again maybe for Milish that would depend on which way the decimal point moved. I ask if there would be a more accurate analogy? What if someone removed the sticker form the .99 hamburger and placed it on the $3.99 hamburger then went through the checkout, does that not make more sense to why the buyer did not correct the error. But wait, Milish left out the most important part of the story, why did the city sell the hamburger, I mean cars, for $50 to him in the first place. That’s right Milish made it appear to council that the junk cars were going to be used to help a non-for profit organization, so the most accurate analogy would be that the deceiver asked the Grocer for old “junk” hamburger for a non-for profit organization to feed hungry animals, to which the Grocer agrees to sell the cars, I mean hamburger for .99. Then when no one is looking, the deceiver gets good hamburger worth $3.99 and tells the clerk at the checkout that the Grocer said he could buy the hamburger for .99 for a non-for profit organization; the clerk believes the deceiver and sells him the hamburger. Now that the deceiver has all this hamburger for the hungry animals what does he do, that’s right, he keeps it for his own use.
Now that Milish has supposedly “returned” the cars to the city does that make it all go away. Are all parties happy, is the issue behind us now or are we just trying to keep it off the front page of the newspaper? I for one say that it is not over and that we keep it on the front page and on the council floor till this and all of the closed-door politics are made public. I for one want to see to it that this sends a message to our new council that this kind of behavior is going to stop. Is the City to just “eat” the loss, after all it is tax dollars that were lost, yours money and mine. Something to think about next time you write out your property tax check. How much money did the City loss? Is the City paying to have the vehicles towed back to the city? Because, it is to my understanding, the once drivable vehicle now has no transmission. The City has loss the use of the vehicle, the value of the vehicle has decreased, and the wear and tear that has occurred over the better part of one year that the vehicle was not in city’s hands. Not to say how much was spent on attorney fees and the immeasurable amount of loss in the disappointment of our city government. If one wants to be the better one, do not stop at just giving the vehicles back, do the right thing and repay the Taxpayers for our losses. Facta non Verba.
I would also like to thank the “lame duck” council members who did vote to seek the truth with outside legal counsel, even though it is to my understanding that none of the recommendations were used in favor of sweeping it under the rug now that the vehicles are “back in city hands”, even though the vehicles had not physically been returned at the time of the newspaper article. Also the Dearborn County Register needs recognized for not “keeping it off the front page”, if it was not for them showing the public the truth the next four year may have been business as usual.

Thank you,
Christopher L. Powell

No matter what rules were established when Dearborn County’s riverboat savings fund was created 13 years ago, county council will use the money to help pay for a jail expansion. Dearborn County Council voted 4-3 Tuesday night to require only a majority vote to use the fund. The county created a particular riverboat revenue fund for capital projects – named Capital Projects Long Term 197 - in 1998. County council then required a unanimous vote to use the savings, a measure each council since has stuck to.According to Dearborn County Auditor Gayle Pennington, the fund contained nearly $15.7 million at the end of October. The money sitting in that account has enticed county officials who believe a jail expansion is needed.
The votes against the removing the unanimous vote requirement were Dennis Kraus, Dan Lansing, and Jim Hughes. Those council members and several people who spoke at the meeting wanted to see the issue go to a referendum so voters could decide. “I think people are concerned we’re going to drain (the fund), which isn’t the case,” councilman Bill Ullrich told Eagle 99.3 Wednesday. “Up until now there hasn’t been a need to address it. This project has the magnitude for a change.” Some of those opponents accused Ullrich, an employee of the Dearborn County Sheriff’s Department, of possessing a conflict of interest before he joined in the “aye” vote to require only a majority. “A conflict of interest is defined as a financial interest in a vote… Whenever there has been anything voted on which would affect me financially I have recused myself,” he said, adding he abstained from a vote on a 2.5 percent raise for county employees during the same meeting Tuesday. Councilman Bryan Messmore’s full-time job is as a victims advocate in the Dearborn County Prosecutor’s Office. He has also been accused of a conflict. “I understand people’s concerns about conflicts of interest and there is fair discussion and fair conversation to be had,” Messmore said. “But, this jail decision is based on the numbers. We’re voting on what we know and what we’ve learned. What’s best for the county, the taxpayers, the sheriff’s office?”Costs for the project which could add up to 150 new beds at the Dearborn County Law Enforcement Center are still fluctuating. The latest estimates given by Indianapolis-based engineering firm RQAW range between $8.4 million and $9.3 million.
While he remains open to funding options using any amount of riverboat savings, Messmore said it would be premature to make a decision until a cost figure can be finalized. The county must still hire a construction manager and could put the job out for bid again, he said.
Ullrich said he would like to see a reasonable amount of money taken from the riverboat fund to pay for the expansion with the remaining cost supported in bonds.
“I don’t think people realize we’ve done our homework on this. I think this is needed and if the voters don’t think so we’ll find out in the next election,” Ullrich said.
County council will next meet January 24, 2012.

Does anyone know how many lawsuits are pending against County for alleged breaches? I get the feeling they have a lot of "clean up" to do. Maybe they are in a rush over this jail funding before anyone does the math on how many issues are on the table for compensation and legal expenses.
I assume that Brewingtons have refiled.
Also, has the architect for jail been paid and with what monies have been used so far?

In response to a facebook post that I cannot respond to, I would like to give my side. In an article of the Thursday December 2 issue of “The Register”, I voiced my concerns about some of the issues that our small town is faced with. All of the issues that I have brought before council and those that are to come were the words of the citizens of our town, which I learned as I walked our streets and talked with the good people of Aurora. In no way was it a result of the election outcome that the issues came out, win, lose or draw the voices of the citizens of Aurora needed to be heard. It was one of the hardest parts of the election, to not sling mud and call names, but from the start I wanted no “politics” in my campaign. The “I did not steal a car today vote for me” and “I am just doing this for the free dirt” shirts I would leave to the other side. In the future if there is an issue that the city of Aurora is not dealing with, I will be happy to stand-up and make sure the citizens know what is happening with our town. If you want an answer, feel free to give me the question and I will do my best to get the answer.

Thank You

Should it take a unanimous vote to spend money in the Riverboat SAVINGS account?
Council is considering changing the unanimous agreement requirement on that SAVINGS account that was set in place in the late 1990's.

Council is considering using this SAVINGS account for the jail expansion. If they do- they will be using about half of the account.
They meet again on Dec 20th at 6:30 PM in the Commissioners Meeting Room

I heard several County Council members want to vote Tues night to change the ordinance on the unanimous vote required to spend the Riverboat Savings account money. They want to do this to spend it for the jail expansion. The purpose of the unanimous vote enacted in the 1990s was to assure that the money was spent on capital projects that the county taxpayer's reps would all agree on. It was to force consensus. It shouldn't be changed unless the vote to change is unanimous. It also should not be changed with the heat of a decision (jail expansion) being asked for right afterwards.
Perhasps a supermajority vote would be a better idea- still 6 votes may be hard to get on this plan.

Angela Loechel billed $50,000 for the ex's divorce/custody battle. Judge Humphrey ordered Brewington to pay $40,000 of the $50,000.
Just how many motions did Loechel have to answer to get to $40,000?
