I am probably not the only one that has noticed this, but ever since the last November election this blog has gone from informative to ignorance and jealousy. The tide has changed and certain individuals were voted out of office. A new change in power has those individuals scared and jealous. With these individuals being voted out of office it gave another elected official that had been previously voted out of office a group that could rally around him and try everything that could to change laws and codes on who can run for office and so on. Everybody claims that this group of elected officials are corrupt. This group is referred to as "Good Ole Boys". I see it as this group is trying to remove the "Good Ole Boys" and they are threatened and will cry and pout and play their childish games to halt this change that is taking place.

Why have we not heard anymore news about the convict that is still as far as I know still on the lose. Do they think he's still in the area or do they know if he has a connection here? I want to know my kid is safe getting on and off the bus or even sitting on the porch. If they so think he has left the area why do they think that? This is something I would like to see on the news

I was with some friends tonight at an event at Lawrenceburg High School. With gas prices high and every one of us struggling to make ends meet, one of my friends said that it must be nice to be Dave Hall. The county jail commander seems to love transporting his family around to events and lots of meals using a sheriff van. It is my understanding that if there is an emergency at the jail, local police will arrive. If Dave Hall can use a sheriff van to transport his family, and technically we as tax payers pay for it, why cant we use a sheriff car or van if we need it? Odds are he is getting gas at the pumps behind the sheriff's dept for free...why cant we? Not complaining...but 6 of us were sitting together tonight and saw Dave and his family and were talking about the new jail and figured this was one more way to save money! Thanks for your time and I love Dave Hall...but would love him more if he would ask to use my tax paying money instead of stealing it!

(Lawrenceburg, Ind.) - A former Dearborn County deputy will be sentenced Thursday afternoon.

Mike Fogle was arrested in April on charges of Forgery, Theft, Attempted Theft, Obstruction of Justice, and two counts of Perjury. An internal investigation revealed that Fogle may have submitted time sheet for hours he had not worked.

He reached a plea deal with prosecutors August 4. Sentencing is scheduled for 3:15 p.m. Thursday in Dearborn Superior Court II.

Fogle was re-arrested Monday on a bond revocation after he violated terms of his bond. He left the state on August 5, going to Famous Dave’s Barbecue in Florence without informing Southeast Regional Community Corrections.

Fogle remains held in the Dearborn County Law Enforcement Center Thursday.

I guess most people know by now about the metal stolen from the highway department. I hate when people feel like stealing from the government is not the same as stealing from a person. I work hard and pay my taxes. So they stole from me and the whole county. I hope people at the tri state scrap yards turn in the piece of s#!t that stole them.

Let me see here Dan Brewington according to the Court has a general disdain for the authority of the court so he rates a 500,000 dollar bond and the most serious charge he is accused of is a class D felony. Then we have Mr. Fogle who plead guilty to a C Felony in a sweetheart plea deal and he is sent home on probation. Furthermore I promise you Fogle knows the terms of his probation and he willing chose to go out of state without permission less than a month after being placed on probation. Anyone want to play the over/under on how much time he gets in jail? My bet is he gets less than the 6 months that Dan has spent in jail with his due process rights trampled upon. Any takers?

All of our charities need some thanks at times and deserve our respect.
Spoiled Acres Animal Rescue 501(C)3 could use both right now. This charity receives no funds from the County or the State.
Spoiled Acres is in financial duress due to recent animal neglect cases and 6 horses seized and entrusted to her care by Pros. office.
A private individual who is caring for 2 of these original 8 horses, HAS been compensated for board, and yet the rescue has never received any financial help.
Spoiled Acres has always helped the County cover for Animal Control issues when no one on duty is available. If I were running Spoiled Acres, I might feel like a doormat by now, or a "dumping ground" for abuse, instead of an org. that should be respected.
This rescue does not waste a dime on anything but essentials. They are working hard to fund raise to feed these horses.
I wish DC would take time to thank Julie, or assist with the expense of caring for these horses.

I have previously posted many comments about the two detectives who "snowballed" me. That's ok...I have been assured their names will be made public real soon and a full investigation of the Dearborn County Detective and Greendale Detective will be conducted by some "big boys". With my luck with the police lately, the last thing I needed was to run into them again. Well, the other night after the Lawrenceburg/South Dearborn football game i was taking my daughter home from work. On the way back to Lburg, my vehicle was hit and the other driver took off. I called 911 and the dispatcher was terrific. Although we went from Aurora to Lburg and all local cops were tied up, Indiana State Police eventually caught up to the other driver. I did not get the names of the troopers, but my mother and daughter who were in the vehicle with me commented, as did I, that these two troopers were exceptionally professional and super nice to us. So i figured if you have had a good experience with the police, share it on here! Maybe this is a way of narrowing down some of the cops who only care about their name getting in the paper (my Greendale Detective looooooves publicity) and could care less about the general public. I had someone last week say "Al, you only care about bashing cops!" Not true...the two criminal detectives are who i am bashing and I am sure I am not the only one who these two have "snowballed". Back to the point, lets share some names of the good cops and get them some good publicity. I will start...I don't know the names of the two ISP troopers, but thank you...your kindness and professionalism was a breath of fresh air! I also watched how you handled the lady who hit my car and I found you to be professional with her also! Will call ISP Versailles tomorrow to get your names and will give you a public thank you for your quick response!

I figured I would lighten things up a little and pick on the postal service. Mail lady comes to deliver mail today and calls the police on me...the reason?!? My 6lb dog was barking at her in a "mean tone" and my dogs four newborn pups (about a pound each) were sitting on the porch with me without a leash. Since i refused to put the pups on a leash, she informed me she would call the police and have me arrested as she was deathly afraid of dogs....ok dumbass---they can't even bark yet! All they do is poop, eat, and sleep---you are not on their priority list---yet! And another thing---my 6lb dog was being held by my wife---what do you want her to do---talk to you instead of barking---for cryin out loud---you are a freakin postal employee---dogs do not like you!

Anyone else tired of our schools wasting our kids time for learning with this bullshit? This has become epidemic in our schools and I am so sick of it. I'm tired of the answer that my child does not have to participate. They are forced to participate and involuntarily sacrifice their learning time to learn about how to become a salesperson and fill out the forms and paperwork and be lured with shitty little prizes for selling this junk.I would much rather they send my kids outside to play and get some exercise than have them listen to this bullshit year after year. There should be no shortage of funding for the school period because they already tax the shit out of us via property tax. Start teaching and stop this waste of my child's time with this bullshit!

Jury trial that was previously set for today was "vacated" last week and the bond reduction hearing will be tomorrow morning- Aug 17 at 10 AM
Writ of habeas corpus was filed last week- Aug 9 in the southern IN district federal court by Brewington and his pro- bono Ohio lawyer.

I just wanted to take a second and clarify a couple of things. First, this will be my last posting on here as now the investigation gets good and I have been told to shut up. Second, I think Dearborn County is a wonderful place to live and I can't think of a finer place to raise a family than Lawrenceburg. Third, I was merely warning those of you who may have limited funds and are under police pressure to confess to something you did not do to please be careful...I have never had a bad dealing with any local authority until last Wednesday. Fourth, I do not think it's right for a two allegedly high-profile detectives to threaten harm to my kids when my kids are not involved in this. Fifth, when anything goes wrong in this county immediately Aaron Negangard is under the gun. As of this minute, Aaron has never been rude or unkind to me personally and has not contacted me about this, probably because I have an attorney. Sixth, while I appreciate friends and those who are against me posting thoughts, don't let your opinions get in the way of facts...while I appreciate both sides, I do not need sympathy or am seeking public rage for me (see number four above). And finally, I was asked by someone today a good question---why would you ever, ever put your name on a blog against the police? My response to him and to you, the Dearborn County public is simple--I did not do anything wrong and one of the detectives had already bragged to other cops who are my friends that he got a "confession"...pure bullshit. I do wish to say to these two crooked detectives, and I won't name you until the feds get done with you but you clearly know who you are---This is a great county, with great people, many caring cops and detectives, many caring and kind citizens...if you are sooo damn anxious to find true criminals than why don't you start by looking in the mirror!

i am a dear friend of al penny and have known him for what seems like forever. we have talked and had dinner many many times over the years and have discussed this case against him since it started and i have no doubt al would never ever do what he is accused of doing. i have lived and worked in greendale for many many years and i cant take it any more. dont we want citizens like al, who for petes sake has never even had a traffic ticket, in our community? he told me he was moving out of town yesterday because he got railroaded. i read the transcript as he described it to a fellow friend after the meeting with the detectives the other day. i mean did they have to threaten his kids? well, i told al this morning that i would put up some money and whatever he needed for me to do. of course, he dont want my money and only asked that if they do arrest him that he come to court and sit by his side---absolutely! i know his funds are limited and he has a family to take care of. i want to tell you that i live alone and i am scared now of my local police (yes, he told me who they were)...they could come to my house and do to me what they did to him and whats my defense? i am willing to go to the jury and tell them that a couple of months ago, in the middle of the night, i had a pipe burst. i could not trust anyone in my home and cannot afford a plumber but i called al and he came over, in the middle of the night, crawled in my flooded crawl space and stayed at my home many hours until this mess was cleaned up. of course i paid him a few bucks for being great but he didnt want any money. he said God blessed him with a skill and he was greatful for this. I read another post calling him a nut...well i dont know about that. all i can say is there are a few good people left in this community and al is certainly one of them

has your wife, daughter, girlfriend, or female significant other been incarcerated in dearborn county lately? while i am on my high-horse about the two detectives who are in deep poop with the fbi, aclu, and others, i got an email today from a person who was crying and said she was recently incarcerated at the local jail. she said the whole time in there certain guards (jail officers if you will) referred to the female population as bitches and kept calling them bitches...i.e. let the bitches go to rec, let the bitches puke, that bitch needs a tampon? so if your wife got caught with a p.i. because she was walking home drunk instead of driving,and was arrested, but you love her with all of your heart, what gives someone else the right to call her a bitch when you never would? i mean...come on dearborn county, i have attached my name...i am standing for my rights...you have rights also! do these same guards go home to their loving spouses and call them bitches? to they go home to their loving daughters and call them bitches? i mean...for real?

per Brewington's public defender info to his family- Brewington trial for Tues has been "vacated" and there will be a bond reduction hearing at 10AM on Wednesday Aug 17.
A writ of habeas corpus was filed with the Federal Court in Southern IN on August 9 by pro-bono attorney Robert Kelly for Daniel P Brewington v Michael Kreinhop. Copies can be obtained or viewed on the court website for a nominal fee.
There are 26 pages at 8 cents a page.

Boyde (1988) 46 Cal.3d 212, 238. As the Jimenez court reiterated, before a confession can be used against a defendant, the prosecution has the burden of proving that it was voluntary and was not the result of any form of compulsion or promise of reward. People v. Jimenez, 21 Cal.3d 595, 602, citing People v. Trout, 54 Cal.2d 576; People v. Berve, 51 Cal.2d 286; People v. Jones (1944) 24 Cal.2d 601, 608; People v. Rogers (1943) 22 Cal.2d 787, 804-805; People v. Siemsen (1908) 153 Cal. 387, 394 [95 P. 863].) If a statement is found to be involuntary, the statement and other evidence derived from it are inadmissible for any purpose. Oregon v. Elstad (1985) 470 U.S. 298, 304-309. As the court explained in People v. Atchley, 53 Cal.2d 160, 169-170, this standard applies to all incriminating statements whether they be confessions in the strict sense or only admissions.

In analyzing whether a defendant’s statements were involuntary and obtained in violation of his rights under the 5th Amendment of the U.S. Constitution and the Due Process Clause of the 14th Amendment, courts go through a process that is described as a “weighing of the circumstances of pressure against the power of resistance of the person confessing.” Stein v. People of State of New York 346 U.S. 156, 185. “In determining whether a defendant’s will had been overborn in any particular case, the courts assess the totality of all of the surrounding circumstances – both the characteristics of the accused and the details of the interrogation.” People v. Cahill (1994) 22 Cal.App.4th 296, 310-311, citing Schneckloth v. Bustamonte, 412 U.S. 218, 225-226. As the court emphasized in Cahill, the reason for excluding involuntary confessions is to provide the accused with an “essentially free and unconstrained choice” whether to confess. People v. Cahill (1994) 22 Cal.App.4th 296, 311, citing Schneckloth v. Bustamonte (1973) 412 U.S. 218, 225-226. That freedom implies freedom from police conduct which is overreaching. Id. at 311, citing Colorado v. Connelly (1986) 479 U.S. 157, 163-164.

I am a disabled person who was coerced into a confession and threatened by two "big name" detectives recently. They refused my right to an attorney and held me until i confessed to something i did not do. One detective said he was tired of this case and wanted it solved so the accuser would stop bugging him, and i could not leave their holding area until i changed my story and confessed so he would not have to continue hearing the accuser bitch. THIS IS NOT A BIG TIME CRIME...NO MURDER, RAPE, ROBBERY, CHILD MOLESTING, THREATENING, DRUGS, NOTHING OF THE SORT. IT WAS ALREADY SOLVED IN CIVIL COURT. I had not eaten for almost 2 days, not slept in almost 2 days, and am severely mentally disabled. So i call the state adult protective services of Indiana to get some protection for fear of retribution toward my family. And they give me the number of guess who? The same guys who are employed by the prosecutor! Now, aaron and the office has never done wrong by me in any way shape or form...but if i want protection, why the heck would i ask for it from the same guys who i am accusing of abusing me? Any suggestions would be helpful as to who to contact.

So how did the meeting go about the jail?
I would like to know what the salary is for the Sheriff now, and how much of an increase will likely get in pay/benefits and and retirement/benefits with this bigger jail?
Who is the architect, or are they trying to pay themselves for the design.
How about pay for the other upper level guys in his office?
Not saying an expansion is not needed, but this needs scrutiny of an outsiders. The in house methods of money management have proven faulty or self-serving in the past. If $25,000 can disappear from County coffers and be excused due to technicalities, how much could fall into the cracks on this project?

Sheriff Kreinop and Commissioner Orshall will be the main speakers. There will be an audience question and answer session immediately following the talks.

Checking out the county website- The ordinance wants all non-governmental website links removed. The business and recreation tabs are full of private enterprise.
Is the county going to enforce its own ordinance?

Just yesterday (July 19) a man in Aurora held a gun on a lady and child near his mailbox. His bond was set at $20,000 surety and $5,000 cash. He was threatening with a gun! Dan Brewington - if he threatened - only used words and he received a bond set at $100,000 and $50,000 cash. Something is very wrong!

One-party rule is usually bad. We need Democrats to prevent Republicans from starting wars and eliminating income taxes on the wealthy. We need Republicans to prevent Democrats from buying votes with public entitlements and allowing labor unions to dictate the terms of public employee contracts. Both parties have bad habits that can only be curbed by a strong opposition. There is no opposition to the Republican Party in Dearborn County, which is why we have serious issues in the Courthouse administration.

Law and order are significant issues upon which voters will often respond in knee jerk fashion. No one wants to be perceived as "soft" on crime. So politicians run to the right and have build up a law enforcement bureaucracy which tends to self supporting. More police, more probation officers, and more staff all create power and influence. Now a new jail will just add to the size (and cost) of this bureaucracy.

Mr. Miller and Mr. Garner are dead on with their observations of what is happening with the jail issue. I applaud them for their courage in standing up for what is right. One observer commented that they ought to run for office. I don't know their politics but wouldn't it be a pity if they were barred from winning by their choice of political party? The Republican party label seems to be the only way to power around here. The jail decisions and others are all being made by one party which has had overwhelming numbers at the polls.

Like Lord Acton said, “Power tends to corrupt; absolute power corrupts absolutely.” There needs to be a second party (or third or fourth) to debate these significant issues in a realistic manner. Folks need to stop making their voting decisions based on just the party label. There are good people everywhere in this County and all should be encouraged to stand up for doing the right thing. (not just the Republicans)

INDIANA - A study is underway in Indiana to determine the impact of decriminalizing marijuana.

The latest national Gallup poll shows that 46 percent of Americans are in favor of legalizing marijuana all together.
Indiana State Representative Tom Knollman said he is not ready to completely legalize the drug but he would like to see it available for people who use it for medical reasons.

“Yes I have inhaled. I mean I went to college like everybody else,” Knollman said.

I have question re: school. Public in this case.
If a young child (9 years old) has dental caries and it can be seen plainly, would the school intercede and encourage the parents to get that child some care? I would think this would be part of the health exams. I do not know if the problem is financial, fear of dentist, or neglect. If these parents were say, on probation, would this be something the probation dept. bring up? She is going to suffer later if she does not get care.
We have not used the local school system, so I am wondering.

Why is the community spirit fading away? I recently found out the Lawrenceburg Fire Department used to raise money for a Childrens Christmas Charity. They worked at a food booth every month and the week of 4-H fair and had a raffle at Fall Fest each year to raise the money to help community children have a good Christmas.

They have now given up the food booth and have no raffle planned, instead they are going to use Lawrenceburg City money to give to the children. What happened to the spirit of giving back to the community by working for it and raising the money. Now they are going to sit on their butts and just pass out city money to try to look good.

I just don't agree...I think that makes them look lazy! Why have the middle man, just let the city give the children Christmas presents instead.

1. Is a referendum required by law if the jail expansion is paid with a mix of funding that puts the tax increase portion well below the $12 million limit?
For example, if the county uses $7 million of Riverboat Revenue Savings account money and taxes the public to pay for the remaining $8 million bond payments, does that require a referendum?
2. Is it legal to have a unanimous Council vote be necessary to spend Riverboat Revenue Savings Account money? Or is a super majority legal?

Unworkable!
Nightmare for County!
What we have now, is based on legitimate criteria. Nothing is perfect, but it works most of the time.
Mr. Hughes, if they establish a Rumpke operation, or a very very large pig farm/noisy slaughterhouse upwind, within earshot of your home (slammed next to Hidden Valley). You will no longer be able to use your property for entertainment, peace and enjoyment. Will you sue because you can no longer use your property for peace and enjoyment? Well, many people are put into this situation. Why should the County pay? If they grant certain things in areas not "user friendly" for it, everyone else will sue. Why do this? Plan and zone the areas and stick to it. It is cheaper and better for most people in the longrun.

Where is all the accounting about the VRUC's Natural Gas division? VRUC's accounting is below bad. VRUC doesn't show Squat for the Natural Gas co! I'd bet Bittner, Hensley, Gutzwiller and Hacker are all involved.
LOL maybe even Floyd Ogden and Bill Blantz from the Corporate office division.
