Subject: UPDATE ON VA'S PACT ACT BILL

August 31, 2022

As part of the PACT ACT which President Biden signed this early August, here are some of the new Agent Orange presumptive conditions added to the list, which can affect you.

From the VA –
Based on the PACT Act, we’ve added 2 new Agent Orange presumptive conditions:
 High blood pressure (also called hypertension)
 Monoclonal gammopathy of undetermined significance (MGUS)

If you think you’re eligible for VA health care and benefits, we encourage you to apply now.

What new Agent Orange presumptive locations will VA add?
We’ve added these 5 new locations to the list of presumptive locations:
Any U.S. or Royal Thai military base in Thailand from January 9, 1962, through June 30, 1976
Laos from December 1, 1965, through September 30, 1969
Cambodia at Mimot or Krek, Kampong Cham Province from April 16, 1969, through April 30, 1969
Guam or American Samoa or in the territorial waters off of Guam or American Samoa from January 9, 1962, through July 30, 1980
Johnston Atoll or on a ship that called at Johnston Atoll from January 1, 1972, through September 30, 1977
If you served on active duty in any of these locations, we’ll automatically assume (or “presume”) that you had exposure to Agent Orange.

The Secretary of the VA said at the recent DAV National Convention in early August, “they are preparing for the thousands of claims submission expected as a result of these new additions.” He also said, “they won’t be ready until January 2023.” However, he stated that “veterans should start filling their claims now.”

In my personal experience and recommendation as a DAV Service Officer:

You should at the very least, submit an Intent to File (VA Form 21-0966). This will tell the VA that you plan to submit a claim, but you don’t know for what or when. With Intent to File form, the VA gives you 365 days to submit you claim along with the necessary evidence. And, if and when they approve (award) your claim, the pay date will back to the date on your Intent to File form.

Many of us have hypertension, but never being to claim it as a disability - now we can and should! Also, our Thailand brothers can now get approved for SC conditions as a result of AO in Thailand.
