The ankle tugging theory is so ridiculous that I don't even know where to begin.

Firstly, Tom would have had to be deep in the water, trying to bring down a man fighting for his life. I don't know how good a swimmer he was, but unless he was in scuba gear, he would have had to come up for air at some point (and rather often, since I'm sure he would have been getting quite a workout in the process). When someone is fighting for their life, the adrenalin gives them a lot of strength they wouldn't normally have under ordinary circumstances (this is something they teach you in lifeguard training, just so you know to expect this if you ever have to rescue someone who is drowning). So obviously this ankle-tugging battle would have generated a lot of splashing, and probably quite a bit of noise. All of which could easily have brought Anna out of the house.

That, in a nutshell, is the main problem I've always had with the murder theory. If Brian was indeed murdered (and I'm not saying he wasn't), then there probably were at least two people in the pool with him, maybe three. Which brings us back to the builders.
