Subject: Miss Califiornia is not a 501(c)3. A quick check on guidestar.org will show you that there is no Miss California Organization registered as a non-profit organization.

[> [> Subject: Miss CA is not a 501c3, Scholarship Associates is. Under their incorporation, scholarships can only be paid to qualified educational institutions. Banks and loan companies are not educational institutions. All Miss CA scholarships are paid by Scholarship Associates other pageants can pay their scholarships anyway their 501c3 paperwork says they can. You may not like it but that's the way it is. If you would like to read the articles for incorporation and the filing for 501c3 status they are public documents that can be requested through the freedom of information act.

[> [> Subject: Bob is also the director of Scholarship Associates (according to their tax filings), so I think he approved the articles of incorporation before signing off on them. The contestants make out their checks to the Miss California Organization. I think many people would feel more secure if they knew exactly where their money was going. If the ad sales checks were made directly out to a non-profit organization, they would have the right to request that information. Unfortunately the checks are made out to the Miss California Pageant (not a non-profit).

[> [> [> Subject: Theoretically since the checks are cut to the Miss California Org and then money is deposited in Scholarship Associates, Bob only has to deposit enough to cut checks for the scholarships earned. Since the board has no oversight of state finances, bob could be running amok with $$, other than that specifically used for S.A.

This is all so crazy lets hope its all false. Hate to think people are not honest. The fact the girls can't pay loans is so unfair and dumb.

[> [> [> Subject: None of how Bob is structuring the organization, by the way, is illegal. How he structures the flow of money into the Scholarship Association & into the pageant is completely legal & not intended to be shady or dishonest. Its just structured in a way to his choosing and advised by financial experts and then people are shocked when they learn about it. They have a vision instead of all monies, ads, fees, and donations are going towards scholarships for the girls but in fact a lot of money is needed to form, bolster, and keep the organization in the black for a variety of reasons revenue/expenditures that our tax codes require. Other states in MAO have choices in how they want to structure their organization. Certain designs within the non-profit org keep a state out of trouble depending on the flow and total monies they have. Bob chooses this algorithm. It's a little bit dated and one of the older designs but it is low risk for MCO to get in trouble & maybe that's what he aims for.

I have an accountant son. He says it's kosher. I believe everything Bob chooses to do is a reaction of something that happened in the past. Don't assume dishonesty just b/c you don't like it. Just ask him why he chooses this design of monies flow. There's probably a good reason.

[> [> [> [> Subject: I don't think anyone would assert that the legal structure is wrong. Nor would they have any problem with the other, substantial expenses that the Miss CA organization incurs. What is unacceptable is the he REFUSES to disclose the complete books of the organization. SHOW us what all the other expenses are. SHOW us the cash inflows and outflows. SHOW us that you are above board and not pilfering money

[> [> [> [> [> Subject: its his legal discretion to opt not to disclose. maybe he would offer info if someone asked him during meetings or in a group letter or maybe if he felt threatened he would lose a substantial number of volunteers if he didn't. someone have the balls to organize and petition your demands! don't include me b/c I read this board as a 'has been' and I don't care anymore. but if you care then do something other than complain and suspect.

[> [> [> [> Subject: I don't know about what is legal or illegal, however I do know that MAO requires that if you say you are offering $100,000 to the 2013 state contestants, then you must have $100,000 in your scholarship account by the date of the pageant and that $100,000 is for the 2013 contestants only.

If Bob is so honest, then why not tell everyone the specifics of MCO's financial situation?

[> [> [> [> [> [> [> [> Subject: The Miss California Organization is a 501(c)(4) non profit, Scholarship Associates, where the scholarships are paid from, is a 501(c)(3) non-profit. Not all non profits are created equal, there are very different rules for these two designations but they are both non profit organizations. If you are interested in the differences here is an exhaustive list.http://nonprofit.about.com/od/becomingtaxexempt/a/nonprofittypes.htm

[> [> [> [> [> [> [> [> [> Subject: I agree that 501(c)4 and 501(c)3 orgs are different types of non-profits, but I urge you to go to guidestar.org and do a search of "Miss California Pageant Inc." Guidestar is a google for non-profits and allows you to see tax filings (form 990) for non-profit organizations. Miss California does not come up in any of these searches. If it were a 501(c)4, you would be able to see their Form 990 (since their gross receipts is over $50,000 annually). If they were a 501(c)4, you would see the form and a box would be checked classifying it as 501(c)4. There is no form for Miss California. There is a form 990 available for Scholarship Associates, but we (contestant supporters and advertisers) don't pay into that organization so we don't get to deduct anything.
