 True statement. It amazes me that the people on this forum can't or don't want to understand how our system works. If you disagree with a judges decision then you have several choices, appeal to a higher court, change venue, change the law or change your case to reflect a different law or set of circumstances. Dan case was heard by the local judge and an appellate judge. They disagreed with his case but did listen. His option was to appeal higher, change his case or attempt to change the law. He could also have tried to elect a different judge in his county so that his case could be reheard. Our system relies on judges decisions being accepted by all parties until they are overturned or upheld. Clearly Dan could not accept the outcome of his trials. He resorted to trying to change the outcome by using his 1st admen rights on the internet. He also began attacking the courts expert on line. He had every opportunity to do that in a court setting by producing counter witnesses to that expert. Over a space of years the weight of his attacks approached a level of 1st admen abuse rather than the mere exersise of it is as a right. His appeal will fail because he must show that there was no escalation during that time. Calling the judge a SOB in a blog after the trial will surely add to his ability to be percieved as in any way repentant. Many continue to say that if he had better representation he would have gone free. The facts in this case would not change even if that were true. How are you going to defend his position? The sitting judge knows the 1st admen very well and if he thought that Dan's was trod upon I am sure he would have made that clear during the trial. Custody issues are determined by what the judge thinks is in the best interest of the child. Not what parents, family or friends think. They can and will defend their right to make that decision in any court setting. The supreme court would be very relunctant to overturn any decision made with that parameter in place. This places many men with young children in a bad spot as courts are relunctant to take young children from their mothers. Dan's frustration with his lack of any abitity to change the courts verdict led him down the path he is now on. I am sure his friends and family have urged him to fight on due to their belief in the justness of his cause. But what I have said here holds true. You will not change the judges decision by pursuing this course. The way is clear through judicial procedings and enacting new or better law. I think I have said my piece.
