Since you mention it being covered in sci-fi I'll mention one of the latest and a suprisingly well done episode of Voyager. The title was "Repentance" or something like that, but it dealt with juris prudence, including the death penalty. In there the convict that befriended Neelix explained how the victims of the family were allowed to play a part because no one else could understand what was taken from them. So you say you don't think it will help a mother who lost a child in the blast, but how can you know, and what gives you the right to make that decision. I know you will say what gives me (someone who believes in the death penalty) the right to kill and I would tell you this, if a cell becomes cancerous you remove it, and if an animal goes rabid you put it to sleep. Sometimes a person proves themselves too savage to be allowed to live. Yes that is answering barabarisim with barbarisim, but that's all the barbarians understand. No matter how far society will come there will always be those who will try to prey upon it.
