In case anyone hasn't seen it already, there's a number of interesting articles and debates on fansubbing over at ANN right now. You can see them all here.

Personally, I think fansubbing has little place in anime fandom right now, and it's gotten way out of control. It sickens me that there are so many people with gigabytes and gigabytes of fansubs but hardly any purchased anime. And I think people who download popular, brand new anime and say it's ok because it hasn't been licensed are just making excuses for getting their favorite anime for free. I mean you know it's *going* to be licensed, so what's the difference whether you download it before or after it happens?

These are some of the places I think fansubs still have a justifiable use: Fansubs are good for distributing anime that has little chance of being licensed. The number of titles that qualify under this is becoming pretty few, though. Even HYD has been licensed now (thus, I'll be deleting the episodes I have and buying the DVDs).

I think fansubs also have a valid place in club showings because they help to bring more fans to anime and more popularity to good shows. But most importantly, they're not as harmful as fansubs, because the club attendee doesn't get ownership of the series. He can't watch it more than once, can't show it to all his friends or make copies of it, and is limited to watching it away from home and only at the time when it's scheduled to be shown. People attending clubs therefore still have incentive to purchase the DVDs.

Finally, I don't see a lot of harm in people downloading shows that aren't available for rent to determine if they like the series. It's kind of unreasonable to expect people to *buy* a series when they don't know if they'll like it. You can rent movies, you can hear songs on the radio or TV, you can check out books or CDs from the library. So if an anime series isn't available for rent or being shown on TV, you should be able to download it as long as you intend to purchase it if you like it.

The problem with the first and third uses, though, is that they can't be regulated. People are given the responsibility to regulate their fansub usage themselves, and most people just aren't responsible/moral enough to do so. So unfortunately, I guess fansubs should be illegal except for educational/club use.

Another thing that has occurred to me is that maybe we shouldn't have CDs in the tape library unless it's a series that will probably never be licensed. When people check out CDs, they can copy the files to their computers and then we lose control of them. We can't call the people and say "Hey, you have to delete those files now" when the show becomes licensed. I remember one guy who used to come in, check out a CD, run to his dorm and copy the files, run back, check out another CD, etc etc. That's no good. =\
